<str<strong>on</strong>g>the</str<strong>on</strong>g> implement<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EU OSH legisl<strong>at</strong>i<strong>on</strong>:› The presence <strong>at</strong> <strong>work</strong>places <str<strong>on</strong>g>of</str<strong>on</strong>g> different levels <str<strong>on</strong>g>of</str<strong>on</strong>g> sub-c<strong>on</strong>tracting can cause alot <str<strong>on</strong>g>of</str<strong>on</strong>g> difficulties when it comes to applying OSH requirements as eachemployer tends to limit preventive measures to its own <strong>work</strong>ers.› Access to preventi<strong>on</strong> services should be facilit<strong>at</strong>ed, in particular for SMEs,especially when <str<strong>on</strong>g>the</str<strong>on</strong>g> requisite expertise is not available within <str<strong>on</strong>g>the</str<strong>on</strong>g> company.The Str<strong>at</strong>egy m<strong>and</strong><strong>at</strong>ed <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> to examine <str<strong>on</strong>g>the</str<strong>on</strong>g>se two specific topics <strong>and</strong> toissue recommend<strong>at</strong>i<strong>on</strong>s.On <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>on</strong>e h<strong>and</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> ACSH has set up a <strong>work</strong>ing party to deal with subc<strong>on</strong>tractingissues. 46 However, despite <str<strong>on</strong>g>the</str<strong>on</strong>g> fact th<strong>at</strong> this particular problem was reiter<strong>at</strong>ed in <str<strong>on</strong>g>the</str<strong>on</strong>g><str<strong>on</strong>g>evalu<strong>at</strong>i<strong>on</strong></str<strong>on</strong>g> report <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> implement<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>structi<strong>on</strong> Sites Directive in2008, very little has been d<strong>on</strong>e under this <strong>work</strong>ing party <strong>and</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> hasacknowledged <str<strong>on</strong>g>the</str<strong>on</strong>g> combined lack <str<strong>on</strong>g>of</str<strong>on</strong>g> acti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> <strong>and</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> ACSH <strong>on</strong>this topic, which represents a major gap in <str<strong>on</strong>g>the</str<strong>on</strong>g> implement<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Str<strong>at</strong>egy.On <str<strong>on</strong>g>the</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r h<strong>and</strong>, subc<strong>on</strong>tracting was <strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> topics <str<strong>on</strong>g>of</str<strong>on</strong>g> discussi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> 2010SLIC Them<strong>at</strong>ic Day. 47 In particular, <str<strong>on</strong>g>the</str<strong>on</strong>g> OSH challenges <str<strong>on</strong>g>of</str<strong>on</strong>g> dealing withsubc<strong>on</strong>tracting chains were discussed, including <str<strong>on</strong>g>the</str<strong>on</strong>g> coordin<strong>at</strong>i<strong>on</strong> difficulties,which increase <str<strong>on</strong>g>the</str<strong>on</strong>g> level <str<strong>on</strong>g>of</str<strong>on</strong>g> risks, <str<strong>on</strong>g>the</str<strong>on</strong>g> problems with l<strong>on</strong>g chains <str<strong>on</strong>g>of</str<strong>on</strong>g> subc<strong>on</strong>tracting<str<strong>on</strong>g>of</str<strong>on</strong>g> cooper<strong>at</strong>i<strong>on</strong> between employers (e.g. because <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>flicting interests orcommunic<strong>at</strong>i<strong>on</strong> problems, in particular with regard to migrant <strong>work</strong>ers), <str<strong>on</strong>g>the</str<strong>on</strong>g>diluti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> resp<strong>on</strong>sibilities, <str<strong>on</strong>g>the</str<strong>on</strong>g> lack <str<strong>on</strong>g>of</str<strong>on</strong>g> training <str<strong>on</strong>g>of</str<strong>on</strong>g> precarious <strong>work</strong>ers in <strong>safety</strong>procedures, etc.The labour inspectors discussed <str<strong>on</strong>g>the</str<strong>on</strong>g> possible soluti<strong>on</strong>s to remedy <str<strong>on</strong>g>the</str<strong>on</strong>g>se problems, inparticular joint liability <str<strong>on</strong>g>of</str<strong>on</strong>g> all <str<strong>on</strong>g>the</str<strong>on</strong>g> subc<strong>on</strong>tracting chain employers (i.e. joint liability<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> administr<strong>at</strong>i<strong>on</strong>, managers <strong>and</strong> directors for <str<strong>on</strong>g>the</str<strong>on</strong>g> payment <str<strong>on</strong>g>of</str<strong>on</strong>g> a fine whenever<str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>fender is a corpor<strong>at</strong>e body; joint liability <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>tractor with <str<strong>on</strong>g>the</str<strong>on</strong>g>subc<strong>on</strong>tractors th<strong>at</strong> perform all or part <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>tract in his premises or under hisresp<strong>on</strong>sibility, for all very serious <str<strong>on</strong>g>of</str<strong>on</strong>g>fences committed by <str<strong>on</strong>g>the</str<strong>on</strong>g>
