Appendix BMaintenance RequirementsState Mandated RequirementVerification of long-term maintenance provisions for post-construction structural and treatmentcontrol measures is mandated by the agencies’ State-issued stormwater permits. For example, theSacramento Areawide NPDES Municipal Stormwater Permit (No. CAS082597) specifies:22. Maintenance Agreement and Transfer: Each Permittee shall require that alldevelopments subject to Development Standards and site specific plan requirementsprovide verification of maintenance provisions for post-construction structural andtreatment control BMPs. Verification shall include one or more of the following asapplicable:a. The developer's signed statement accepting responsibility for maintenance until themaintenance responsibility is legally transferred to another party; orb. Written conditions in the sales or lease agreement that require the recipient toassume responsibility for maintenance; orc. Written text in project conditions, covenants and restrictions for residentialproperties assigning maintenance responsibilities to a home owner’s association, orother appropriate group, for maintenance of structural and treatment control BMPs;ord.
