Typically maintenance agreements and covenants are recorded with the deed for the property andfollow property ownership. The agreements generally include provisions for the permittingagency to recover costs for maintenance in the event that the property owner fails to fulfill theirobligations. Check with the local permitting agency about the timing for execution <strong>of</strong> theagreement.Recommended Inspection and Maintenance ProceduresA stand-alone table listing recommended inspection and maintenance procedures is provided atthe end <strong>of</strong> the fact sheet for each <strong>of</strong> the above control measures. The intent is for the applicabletable(s) to be incorporated into the maintenance agreement for the project with amendments asneeded by the project designer and property owner to pertain to the unique project conditions. Itis the responsibility <strong>of</strong> the project designer to inform the permitting agency <strong>of</strong> the complete set <strong>of</strong>necessary inspection and maintenance requirements that will provide long-term continuedperformance and sustainability <strong>of</strong> the measures.Reconstruction or Replacement <strong>of</strong> Failed FacilitiesIn addition to inspecting and performing maintenance on the stormwater quality controlmeasure(s), the property owner will be required by the maintenance agreement or permit toreconstruct or replace the measure when it ceases to function properly. For informationalpurposes, the table on the next page summarizes projected life span information for the variousstormwater quality control measures, based on available literature.Example Maintenance AgreementsEach agency will likely use a different format for the maintenance verification. For examplepurposes, two standard maintenance covenants/agreements are provided at the end <strong>of</strong> thisappendix, for the County <strong>of</strong> <strong>Sacramento</strong> and <strong>City</strong> <strong>of</strong> <strong>Sacramento</strong>, respectively.
