Hon’ble Mr Justice Leonard EzraUnyolo, <strong>Chief</strong> Justice <strong>of</strong> <strong>the</strong> Republic<strong>of</strong> Malawi be<strong>in</strong>g greeted at <strong>the</strong>Reception organised by Supreme Court<strong>of</strong> India Bar Association at New DelhiCurrently <strong>the</strong>re is no <strong>in</strong>stitution charged with <strong>the</strong> responsibility <strong>of</strong> mak<strong>in</strong>g <strong>in</strong>ternational law,which is b<strong>in</strong>d<strong>in</strong>g on <strong>all</strong> nations and peoples <strong>of</strong> <strong>the</strong> world. The UN and regional agenciesdo not possess such powers <strong>of</strong> mak<strong>in</strong>g enforceable <strong>in</strong>ternational law. It is a naturalconsequence <strong>of</strong> <strong>the</strong> absence <strong>of</strong> authoritative law-declar<strong>in</strong>g mach<strong>in</strong>ery that many <strong>of</strong> <strong>the</strong>pr<strong>in</strong>ciples <strong>of</strong> <strong>in</strong>ternational law, and even more <strong>the</strong> detailed application <strong>of</strong> accepted pr<strong>in</strong>ciplesare uncerta<strong>in</strong>. Powerful countries are <strong>the</strong>refore able to flout <strong>the</strong> law with impunity under<strong>the</strong> pretext that it is vague.Consider<strong>in</strong>g that obedience to <strong>in</strong>ternational law has not re<strong>all</strong>y been achieved by diplomaticmeans, more <strong>in</strong>novative techniques must be established. In this regard enforcement canbe achieved through compulsory litigation before a world court that is given power toenforce compliance. Today’s ch<strong>all</strong>enge is to enhance <strong>the</strong> effectiveness <strong>of</strong> procedures and <strong>in</strong>stitutions established to promoteaccountability <strong>of</strong> governments <strong>in</strong> <strong>in</strong>ternational law.New trends concern<strong>in</strong>g enforcement suggest that <strong>the</strong> best approach may ei<strong>the</strong>r be to reform exist<strong>in</strong>g bodies <strong>in</strong> order to give<strong>the</strong>m expanded mandate or to create entirely new <strong>in</strong>stitutions which are representative and with power to compel compliancewith <strong>the</strong>ir mandate. Consider<strong>in</strong>g that one <strong>of</strong> <strong>the</strong> major weaknesses <strong>of</strong> <strong>in</strong>ternational law is that <strong>the</strong>re is no representative lawmak<strong>in</strong>g body, it is imperative that <strong>the</strong> <strong>in</strong>ternational community moves swiftly towards creat<strong>in</strong>g a legislative body to keep<strong>in</strong>ternational law abreast <strong>of</strong> <strong>the</strong> legitimate needs <strong>of</strong> <strong>the</strong> <strong>in</strong>ternational community.Similarly, given <strong>the</strong> <strong>in</strong>creas<strong>in</strong>g need for <strong>in</strong>ternational law enforcement <strong>in</strong> cases where <strong>in</strong>ternational peace and security are atstake, one must recognize <strong>the</strong> importance <strong>of</strong> creat<strong>in</strong>g a world court with compulsory jurisdiction. The political and geographicaldiversity <strong>of</strong> <strong>the</strong> causes <strong>of</strong> <strong>in</strong>ternational conflicts may require reactions o<strong>the</strong>r than those by <strong>the</strong> central authority <strong>of</strong> <strong>the</strong>Security Council. To this end provision must be made for effective <strong>in</strong>ternational law enforcement <strong>in</strong> <strong>the</strong> event <strong>of</strong> <strong>the</strong>Security Council’s <strong>in</strong>action due to its exercise <strong>of</strong> <strong>the</strong> veto power.As <strong>the</strong>re is no <strong>in</strong>ternational court with compulsory jurisdiction to enforce <strong>in</strong>ternational law, creat<strong>in</strong>g such <strong>in</strong>stitution underauspices <strong>of</strong> <strong>the</strong> UN would be an alternative to reform<strong>in</strong>g an exist<strong>in</strong>g body. The new Court would have jurisdiction over<strong>in</strong>ternational law matters. States as well as corporations and <strong>in</strong>ternational organizations could be parties before <strong>the</strong> Court.The biggest obstacle to <strong>the</strong> creation <strong>of</strong> a forum <strong>of</strong> this nature would be recognition <strong>of</strong> its jurisdiction by states. Therecognition <strong>of</strong> such jurisdiction would mean a fur<strong>the</strong>r limitation on state sovereignty. However, <strong>the</strong> task <strong>of</strong> promot<strong>in</strong>g<strong>in</strong>ternational law is <strong>of</strong> such tremendous importance that it requires a partial sacrifice on sovereignty. Where protection <strong>of</strong> <strong>the</strong>planet for <strong>the</strong> sake <strong>of</strong> children and future generations and state sovereignty clash, <strong>the</strong> later should give way.Although for a variety <strong>of</strong> political and practical reasons states prefer to resolve disputes <strong>of</strong> an <strong>in</strong>ternational nature <strong>in</strong>domestic tribunals it should always be borne <strong>in</strong> m<strong>in</strong>d that most <strong>in</strong>ternational law problems are planet-wide <strong>in</strong> scope. Theyconsequently demand global solutions. The recent handl<strong>in</strong>g <strong>of</strong> terror suspects by <strong>the</strong> World’s major powers clearly exposes<strong>the</strong> limitations <strong>of</strong> domestic legal systems. Moreover, <strong>the</strong>re are several obstacles to enforc<strong>in</strong>g domestic<strong>all</strong>y implemented<strong>in</strong>ternational law, namely: sovereignty, <strong>the</strong> doctr<strong>in</strong>e <strong>of</strong> stand<strong>in</strong>g and <strong>the</strong> pr<strong>in</strong>ciple <strong>of</strong> forum non-conveniens.Resolv<strong>in</strong>g <strong>in</strong>ternational global problems at domestic and regional levels would also lead to <strong>the</strong> proliferation <strong>of</strong> tribunals. Thiscan have adverse consequences <strong>in</strong> that it is difficult to ma<strong>in</strong>ta<strong>in</strong> uniformity and consistency <strong>in</strong> <strong>the</strong> application and enforcement<strong>of</strong> <strong>in</strong>ternational law. A global body would also act as a backstop where national courts are unwill<strong>in</strong>g or unable to adjudicatedue to political or o<strong>the</strong>r reasons.Some contend that <strong>the</strong> hope for a secure future lies, not <strong>in</strong> <strong>the</strong> build<strong>in</strong>g <strong>of</strong> a few ambitious global <strong>in</strong>stitutions <strong>of</strong> a universalmembership but <strong>in</strong> regional <strong>in</strong>stitutions. However, experience with regional <strong>in</strong>stitutions has taught us that pr<strong>in</strong>ciple can besacrificed at <strong>the</strong> altar <strong>of</strong> unity and that global problems demand global solutions. Regionalism also tends to underm<strong>in</strong>e <strong>the</strong>universality <strong>of</strong> <strong>in</strong>ternational standards.--21--
