Hon’ble Madam Justice Sarada Shrestha,Judge, Supreme Court <strong>of</strong> Nepal be<strong>in</strong>gpresented with Conference Mement<strong>of</strong>ramework <strong>of</strong> national law.The grow<strong>in</strong>g economic <strong>in</strong>teraction among nations has given rise to a multilateral systemunder <strong>the</strong> WTO, and codification <strong>of</strong> <strong>the</strong> <strong>in</strong>ternational economic law. It is ano<strong>the</strong>r areawhere narrow domestic w<strong>all</strong>s <strong>of</strong> protectionism are brought down. Everyth<strong>in</strong>g under thisemergent regime might have not been <strong>in</strong> <strong>the</strong> <strong>in</strong>terest <strong>of</strong> <strong>the</strong> people <strong>of</strong> <strong>the</strong> South, but at <strong>the</strong>moment, o<strong>the</strong>r than creatively <strong>in</strong>terpret<strong>in</strong>g <strong>the</strong> provisions <strong>in</strong> our favor, <strong>the</strong>re seems to beno way out to opt out <strong>of</strong> <strong>the</strong> system. Therefore, it is a ch<strong>all</strong>enge <strong>of</strong> social justice to ensurethat ‘<strong>the</strong> .haves not’ are not fur<strong>the</strong>r pauperized because <strong>of</strong> this system.The growth <strong>of</strong> non-state rules <strong>in</strong> economic transaction such as <strong>the</strong> Universal CommercialPractice (UCP) I on letter <strong>of</strong> credits, <strong>the</strong> International Standard Organization (ISO) rules on environmental compliance and<strong>the</strong> Type Two agreements <strong>in</strong> Johannesburg have created new possibilities <strong>of</strong> a legal regime <strong>of</strong> voluntary compliance both <strong>in</strong><strong>in</strong>ternational and domestic sphere. Therefore, for those <strong>of</strong> us who believe <strong>in</strong>’ ‘<strong>the</strong> rule <strong>of</strong> law’ <strong>the</strong> emergent regime seems tobe more <strong>the</strong> rule <strong>of</strong> <strong>in</strong>ternational law than <strong>the</strong> domestic law. I know this will be difficult for adherents <strong>of</strong> orthodox Diceyanviews, but this seems to be <strong>the</strong> reality <strong>of</strong> today from which <strong>the</strong>re seems to be no escape.Certa<strong>in</strong> weaknesses <strong>in</strong> <strong>the</strong> <strong>in</strong>ternational legal system seem to be <strong>the</strong> frequent failure to settle <strong>the</strong> disputes concern<strong>in</strong>g <strong>the</strong>ma<strong>in</strong>tenance <strong>of</strong> status quo versus - overthrow. Ano<strong>the</strong>r problem <strong>of</strong>ten-raised about <strong>in</strong>ternational law is <strong>the</strong> lack <strong>of</strong> effectiveenforcement mechanism. This does not however mean that <strong>the</strong> <strong>in</strong>ternational law has no sanction for its enforcement. Thesanction it possesses seems precarious <strong>in</strong> <strong>the</strong>ir operation particularly for those states, which are less able than o<strong>the</strong>rs toassert <strong>the</strong>ir own rights effectively. But it is not essenti<strong>all</strong>y different <strong>in</strong> <strong>the</strong> domestic legal regime where voluntary fulfillment <strong>of</strong>obligation is hardly done by <strong>the</strong> strong. Sanction <strong>in</strong> <strong>the</strong> traditional legal sense is also be<strong>in</strong>g evolved <strong>in</strong> <strong>the</strong> doma<strong>in</strong> <strong>of</strong><strong>in</strong>ternational law, For <strong>in</strong>stance, <strong>the</strong> dispute settlement mechanisms created under <strong>the</strong> WTO, and <strong>the</strong> sanctions that arc likely-under <strong>the</strong> Treaty <strong>of</strong> Rome that created <strong>the</strong> International Crim<strong>in</strong>al Court amply give <strong>the</strong> message that it is not a systemwithout sanction. As mentioned above <strong>the</strong> sanctions get reflected <strong>in</strong> <strong>the</strong> read<strong>in</strong>ess <strong>of</strong> <strong>the</strong> state to shoulder responsibility. Inspite <strong>of</strong> <strong>the</strong> cynical views that doubt <strong>the</strong> enforceability <strong>of</strong> <strong>in</strong>ternational law, it is not so <strong>in</strong> reality. Therefore to sum up, I wouldra<strong>the</strong>r argue that complementary <strong>of</strong> <strong>in</strong>ternational and national law has come here to stay and <strong>the</strong>re is no escape for statesfrom honor<strong>in</strong>g <strong>the</strong> dictates <strong>of</strong> <strong>in</strong>ternational law <strong>the</strong> global change <strong>in</strong> many aspects <strong>of</strong> modem life, states’ function hasnecessitated <strong>the</strong> strong <strong>in</strong>ternational law and effective enforcement system but such a system as I would argue should take<strong>in</strong>to account <strong>the</strong> concerns <strong>of</strong> least developed and landlocked nations, which require strong support <strong>of</strong> <strong>in</strong>ternational communityto do well for <strong>the</strong>ir people.A catastrophe may <strong>in</strong>tervene and <strong>in</strong>terrupt or destroy what is be<strong>in</strong>g done, buteven <strong>the</strong>n <strong>the</strong> f<strong>in</strong>al result is sure. For <strong>in</strong> any case <strong>the</strong> unification is a necessity <strong>in</strong><strong>the</strong> course <strong>of</strong> Nature, an <strong>in</strong>evitable movement and its achievement can be safelyforetold. Its necessity for <strong>the</strong> nations also is clear, for without it <strong>the</strong> freedom <strong>of</strong><strong>the</strong> sm<strong>all</strong> nations can never be safe hereafter and even large and powerful nationscannot re<strong>all</strong>y be secure.— Sri Aurob<strong>in</strong>do--62--
