5th International Conference <strong>of</strong> <strong>Chief</strong> <strong>Justices</strong> <strong>of</strong> <strong>the</strong> WorldInaugural Address byHon’ble Mr. H.R. BhardwajUnion M<strong>in</strong>ister for Law and Justice, Government <strong>of</strong> IndiaI feel a great privilege to extend a very hearty welcome to <strong>all</strong> our guests who havearrived <strong>in</strong> India on <strong>the</strong> <strong>in</strong>vitation <strong>of</strong> Mr Gandhi to attend <strong>the</strong> 5th International Conference<strong>of</strong> <strong>the</strong> <strong>Chief</strong> <strong>Justices</strong> <strong>of</strong> <strong>the</strong> World to take a pledge on Article 51 (c) <strong>of</strong> <strong>the</strong> Constitution<strong>of</strong> India. I congratulate Mr Gandhi, his staff and students for organiz<strong>in</strong>g such a wonderfulfunction. It is <strong>in</strong>deed appropriate that Mr Gandhi has heavily relied upon <strong>Judges</strong> <strong>in</strong> orderto promote peace and friendship because judges do not speak <strong>the</strong> language <strong>of</strong> diplomacy.<strong>Judges</strong> and Lawyers have a cont<strong>in</strong>uous work and as a matter <strong>of</strong> fact <strong>all</strong> <strong>of</strong> <strong>the</strong>m strugglefor dispensation <strong>of</strong> justice and uphold rule <strong>of</strong> law and only <strong>the</strong> judges can declare “Beyou ever so high you are not above <strong>the</strong> law”. This is a message which is acceptable to <strong>the</strong>humanity at large. Article 51 is conta<strong>in</strong>ed <strong>in</strong> <strong>the</strong> ‘directive pr<strong>in</strong>ciple <strong>of</strong> state policy’ <strong>in</strong> ourConstitution. We have argued <strong>in</strong> India between <strong>the</strong> fundamental rights and <strong>the</strong> directivepr<strong>in</strong>ciples, <strong>the</strong>re is a history beh<strong>in</strong>d it. I will not take your time to rem<strong>in</strong>d what has happened when <strong>the</strong> struggle between <strong>the</strong>fundamental rights and <strong>the</strong> directive pr<strong>in</strong>ciple started and where it ended. It ended exactly <strong>in</strong> erosion <strong>of</strong> Parliament power<strong>in</strong> India. There was a time when <strong>the</strong> directive pr<strong>in</strong>ciples were <strong>the</strong> guid<strong>in</strong>g pr<strong>in</strong>ciple <strong>of</strong> <strong>the</strong> state policy and <strong>the</strong> Supreme Courtaccepted it. But as <strong>the</strong> time marched, this philosophy <strong>of</strong> accept<strong>in</strong>g <strong>the</strong> directive pr<strong>in</strong>ciples, that <strong>the</strong> guid<strong>in</strong>g star <strong>of</strong> <strong>the</strong> dest<strong>in</strong>y<strong>of</strong> <strong>the</strong> nation, is no more seen <strong>in</strong> <strong>the</strong> judgments <strong>of</strong> <strong>the</strong> Supreme Court. It has changed, but <strong>the</strong> fact rema<strong>in</strong>s <strong>the</strong> Found<strong>in</strong>gFa<strong>the</strong>rs <strong>of</strong> India were great visionaries. They had seen <strong>the</strong> world, <strong>the</strong>y had seen <strong>the</strong> World War I, <strong>the</strong>y had seen <strong>the</strong> WorldWar II, and <strong>the</strong>y had seen several revolutions, several struggles, and several changes. They had known Magna Carta, <strong>the</strong>yhad known rights <strong>of</strong> man, <strong>the</strong>y had known <strong>the</strong> different struggle for freedom <strong>of</strong> various countries and <strong>the</strong>y were deeplyimpressed and impressed because India is a great civilization. Our part has been from <strong>the</strong> ancient time <strong>the</strong> part <strong>of</strong> ‘Dharma’and if one can f<strong>in</strong>d equivalent <strong>of</strong> ‘Dharma’ <strong>in</strong> English it is <strong>the</strong> cause <strong>of</strong> rightousness that is what prevailed <strong>in</strong> ancient India andthat is why <strong>the</strong> first th<strong>in</strong>g we say is ‘Satyamev Jayate’ Truth prevails and we fur<strong>the</strong>r take this, truth is God, truth is beauty‘Satyam Shivam Sundaram’. So Indian civilization attaches great significance to <strong>the</strong> world family. Even <strong>the</strong> ancientscriptures <strong>the</strong> Vedas, <strong>the</strong> Vedantas <strong>the</strong>y say, I give briefly a quotation from Sanskrit,Aham nijah paroveti garana laghu chetsaamUdar charitana antu vasudhaiv kutumbakumThis is m<strong>in</strong>e, this is not m<strong>in</strong>e, is <strong>the</strong> th<strong>in</strong>k<strong>in</strong>g <strong>of</strong> petty m<strong>in</strong>ds. The large hearted people take <strong>the</strong> world as one family. So, it is<strong>in</strong> our scripture that we say <strong>the</strong> world is one family. The first showcase from Isaa Upnishad, which is a part <strong>of</strong> Vedanta’s,Isavasyam idam sarvam yat k<strong>in</strong>chaya jagatyam jagat,Tena tyaktena bhunjithah ma gridhah kasyasvid dhanamHon’ble Mr Hansraj Bhardwaj, UnionM<strong>in</strong>ister <strong>of</strong> Law and Justice, Government<strong>of</strong> India address<strong>in</strong>g <strong>the</strong> ConferenceIt says that not only this world, this and <strong>the</strong> o<strong>the</strong>r world, <strong>the</strong> galaxies and galaxies, <strong>the</strong>y are <strong>all</strong> dom<strong>in</strong>ated by one God,‘Laillah illilah Mohammaddur Rasul Allah’. The God is one which prevails <strong>the</strong> whole universe and <strong>the</strong>refore you have tolook only to <strong>the</strong> God <strong>in</strong> true lights. It does not separate. Therefore, you should be contended what is given <strong>in</strong> dest<strong>in</strong>y to youby God. This is our ethos that is why our found<strong>in</strong>g fa<strong>the</strong>rs added Article 51. We do not want to fight, we want to assimilate,we want to cooperate, we want to unite, that is <strong>the</strong> philosophy <strong>of</strong> <strong>the</strong> Indian civilization.The second one great message that India has given to rest <strong>of</strong> <strong>the</strong> world ‘Tamaso ma jyotirgamaye’. Vedanta gave; lead mefrom darkness to light. What is darkness? Darkness is ignorance, light is knowledge. India stands for knowledge and Godsays spread <strong>the</strong> knowledge to <strong>the</strong> entire humanity. The first part <strong>of</strong> Vedas says, ‘Oh mank<strong>in</strong>d, I am creat<strong>in</strong>g you to spreadknowledge throughout <strong>the</strong> world. I am mak<strong>in</strong>g you alike’, everybody has a nose, everybody has eyes, and everybody has--8--

God has not discrim<strong>in</strong>ated between man and man, He creates <strong>the</strong>m alike and Heorda<strong>in</strong>ed that you should spread knowledge. But, we are not spread<strong>in</strong>g <strong>the</strong> knowledge;we are not say<strong>in</strong>g <strong>the</strong> truth, we are not speak<strong>in</strong>g <strong>the</strong> truth. That is why <strong>all</strong> this f<strong>all</strong>acies <strong>in</strong><strong>the</strong> world order. The whole philosophy <strong>of</strong> India which Vivekanand propagated <strong>all</strong> over<strong>the</strong> world, are two sentences ‘Utthishthitah Jagratah’. Oh mank<strong>in</strong>d, awake and arise.What is awaken<strong>in</strong>g and what is arise? All <strong>the</strong> movements <strong>of</strong> freedom which India hassupported, whe<strong>the</strong>r it is <strong>in</strong> African cont<strong>in</strong>ent or elsewhere. It is based on <strong>the</strong> pr<strong>in</strong>ciplethat man cannot be a slave <strong>of</strong> ano<strong>the</strong>r and that is why U.N. Charter says. All are bornequal, you may be big nation, you may be a sm<strong>all</strong> nation but as a nation you are <strong>all</strong> equal.There is no big or sm<strong>all</strong> <strong>in</strong> <strong>the</strong> eyes <strong>of</strong> God, He treats <strong>the</strong>m <strong>all</strong> equal. If <strong>the</strong> God has notcreated everybody equal He will create many-many suns. There is only one sun whichsh<strong>in</strong>es over <strong>the</strong> globe and God has put this sun <strong>in</strong> such orbit that it gives warmth to <strong>the</strong> entire humanity, it does notdiscrim<strong>in</strong>ate. So, that is <strong>the</strong> philosophy <strong>in</strong> which India has believed s<strong>in</strong>ce ancient times and our Found<strong>in</strong>g Fa<strong>the</strong>rs were greatvisionaries, aga<strong>in</strong> I am say<strong>in</strong>g, <strong>the</strong>y were <strong>in</strong>fluenced by <strong>the</strong> scriptures <strong>of</strong> India and I tell you not only <strong>the</strong> Indian scriptures isnot one, we have f<strong>in</strong>est <strong>of</strong> Vedas, we have f<strong>in</strong>est <strong>of</strong> Islam. It is Islam which brought equality to India. It is Article 14 directlyderived from Islam, equality no duality. Then <strong>the</strong>se <strong>all</strong> compassions, tolerance <strong>the</strong>y are <strong>all</strong> from <strong>the</strong> precepts <strong>of</strong> Jesus Christ.We have <strong>the</strong> f<strong>in</strong>est <strong>of</strong> Christianity; we have <strong>the</strong> f<strong>in</strong>est <strong>of</strong> Buddhism, we have f<strong>in</strong>est <strong>of</strong> Ja<strong>in</strong>ism and that is why this is a greatcivilization. It is here Rab<strong>in</strong>dra Nath Tagore said, ‘We do not want to go by <strong>the</strong> dry reasons or explanations, we will receiveeverybody with warmth because <strong>the</strong> Vedas says that <strong>the</strong> knowledge should be welcomed from <strong>all</strong> directions’.‘Tanobhadra’ <strong>all</strong> <strong>the</strong>se pr<strong>in</strong>cipals take us to one message tell us only one message peace, tranquility, friendship, unity,cooperation, tolerance and compassion. Note to know that <strong>the</strong>re are no two op<strong>in</strong>ions about <strong>the</strong>se virtues and essenti<strong>all</strong>y<strong>the</strong>se virtues form <strong>the</strong> core <strong>of</strong> <strong>all</strong> religions, <strong>all</strong> scriptures. It is we when we distort religion, religion is very powerful weapon,it can be very-very purify<strong>in</strong>g your soul, but if you distort religion it will be <strong>the</strong> most dangerous weapon for mank<strong>in</strong>d.Therefore, what we say is treat <strong>all</strong> equal, treat everybody with compassion because God is tolerant and compassionate sowe should follow <strong>the</strong> example <strong>of</strong> God who is <strong>the</strong> creator <strong>of</strong> <strong>all</strong> <strong>of</strong> us.Now, turn<strong>in</strong>g to <strong>the</strong> role <strong>of</strong> judges, everybody knows that <strong>the</strong> judges and <strong>the</strong> lawyers <strong>all</strong> over <strong>the</strong> world are united. Why are<strong>the</strong>y united? Because we are not diplomats, distortionists. You can see <strong>in</strong> <strong>the</strong> most difficult time <strong>the</strong> <strong>Judges</strong> and Lawyersspeak <strong>the</strong> language <strong>of</strong> law. They do not know any o<strong>the</strong>r language, be it <strong>in</strong> any part <strong>of</strong> <strong>the</strong> world. They always say what <strong>the</strong>irconscience and conviction tell <strong>the</strong>m. So, <strong>the</strong>y are <strong>the</strong> purest form <strong>of</strong> mank<strong>in</strong>d and that is why <strong>the</strong>y have courage, <strong>the</strong>y havecommitment to truth and justice is truth and quest <strong>of</strong> <strong>all</strong> <strong>the</strong> judges is truth; discover<strong>in</strong>g <strong>the</strong> truth. Therefore, <strong>the</strong>y are <strong>the</strong>persons who can br<strong>in</strong>g peace. But <strong>the</strong>y are very sm<strong>all</strong> <strong>in</strong> number, <strong>the</strong>y don’t have weapons. Their only weapon is what <strong>the</strong>yexhort to mank<strong>in</strong>d. But I am very happy that <strong>in</strong> <strong>all</strong> constitutional societies, Judiciary has been given a very important role, arole <strong>of</strong> arbiter and our Found<strong>in</strong>g Fa<strong>the</strong>rs have given such a powerful weapon <strong>in</strong> <strong>the</strong> hands <strong>of</strong> judiciary <strong>in</strong> India. They canannul any Act <strong>of</strong> Parliament even <strong>the</strong> constitutional amendments. They can set aside any order <strong>of</strong> <strong>the</strong> executive, be it be <strong>the</strong>Prime M<strong>in</strong>ister or a M<strong>in</strong>ister. They can look <strong>in</strong>to <strong>the</strong> actions <strong>of</strong> <strong>all</strong> organs <strong>of</strong> <strong>the</strong> state and correct <strong>the</strong>m wherever <strong>the</strong>corrections are necessary. They have huge responsibility and I th<strong>in</strong>k so that on <strong>the</strong>se pr<strong>in</strong>ciples <strong>the</strong>re is unanimity and worldconsensus that <strong>the</strong> Lawyers and <strong>the</strong> judges must be <strong>in</strong>dependent. They should not be dependent on any part <strong>of</strong> state, anyorgan <strong>of</strong> <strong>the</strong> state and when you give this responsibility to judges I th<strong>in</strong>k <strong>the</strong> world is safe <strong>in</strong> <strong>the</strong>ir hands. I can only say thatif peace will ever come, it will come through <strong>the</strong> mouths <strong>of</strong> judges or nowhere, no m<strong>in</strong>isters, no diplomats. I was a member<strong>of</strong> an organization a long time back, it was an American organization ‘World Peace through Law Center’. We participated<strong>in</strong> several conferences and <strong>the</strong>reafter I th<strong>in</strong>k it faded away, <strong>the</strong> organization doesn’t exist. I th<strong>in</strong>k this movement <strong>of</strong> MrGandhi is far stronger than any o<strong>the</strong>r organization that I have attended so far.Initi<strong>all</strong>y your voice may not be heard by Dr. K<strong>of</strong>i Annan or any o<strong>the</strong>r diplomat who do not act properly at right time. Weshould not discrim<strong>in</strong>ate between <strong>the</strong> nations and nations. If <strong>the</strong>re is a poor nation, if <strong>the</strong>re is week nation-f<strong>in</strong>anci<strong>all</strong>y oreconomic<strong>all</strong>y, so <strong>the</strong>y should not be treated as <strong>the</strong> second grade nation. All nations are represented by <strong>the</strong>ir people and<strong>the</strong>refore <strong>all</strong> <strong>the</strong> nations are entitled to equality and equal treatment <strong>of</strong> United Nations. Unfortunately this is not happen<strong>in</strong>g.--9--
