Bhardwaj, Union M<strong>in</strong>isterfor Law & <strong>Justices</strong>, Government <strong>of</strong> Indiawho <strong>in</strong>augurated <strong>the</strong> 5th InternationalConference as <strong>Chief</strong> Guest speak<strong>in</strong>g toMr Jagdish Gandhileaders emphasized on lesser important issues that suited <strong>the</strong>ir <strong>in</strong>dividual countries.When <strong>the</strong> children’s heart-rend<strong>in</strong>g appeal to safeguard <strong>the</strong>ir future failed to elicit a positiveresponse from <strong>the</strong> United Nations and <strong>the</strong> political leadership, I, as <strong>the</strong> self appo<strong>in</strong>tedguardian <strong>of</strong> <strong>the</strong> welfare <strong>of</strong> world’s children, was deeply disturbed and could not decidewhom to approach next.I <strong>the</strong>n discussed <strong>the</strong> children’s issue with Hon’ble members <strong>of</strong> judiciary <strong>in</strong> which ittranspired that <strong>the</strong> provisions <strong>of</strong> Article 51clause (c) <strong>of</strong> <strong>the</strong> Constitution <strong>of</strong> India, may actas a beacon for cooperation, co-existence, world unity and world peace which alonecan safeguard <strong>the</strong> future <strong>of</strong> world’s children.After such consultation, I first convened a Roundtable Conference on Article 51 <strong>of</strong> <strong>the</strong> Constitution <strong>of</strong> India on 14thJanuary 2001 which was <strong>in</strong>augurated by Hon’ble Mr Justice Syed Saghir Ahmed, former Judge <strong>of</strong> <strong>the</strong> Supreme Court <strong>of</strong>India, to consider <strong>the</strong> issue. Thus began a series <strong>of</strong> deliberations.Then I approached Hon’ble Mr Justice R. S. Pathak, former <strong>Chief</strong> Justice <strong>of</strong> India, former Judge, International Court <strong>of</strong>Justice, Member, Permanent Court <strong>of</strong> Arbitration (The Hague) and Hony. Member <strong>of</strong> <strong>the</strong> Bench, Gray’s Inn, London anddiscussed <strong>the</strong> issue <strong>of</strong> mobiliz<strong>in</strong>g <strong>the</strong> support <strong>of</strong> <strong>the</strong> world judiciary for <strong>the</strong> children’s cause. Mr Justice Pathak admittedthat <strong>the</strong> judgements <strong>of</strong> <strong>the</strong> International Court <strong>of</strong> Justice were <strong>of</strong>ten ignored. This brought out <strong>the</strong> facts <strong>of</strong> non-enforceability<strong>of</strong> present <strong>in</strong>ternational laws and <strong>the</strong> urgent need for ‘Enforceable International Laws’ which only a leg<strong>all</strong>y-constitutedWorld Parliament can enact.Under <strong>the</strong> patronage <strong>of</strong> Mr Justice Pathak, a national-level Sem<strong>in</strong>ar on Article 51 <strong>of</strong> <strong>the</strong> Constitution <strong>of</strong> India was convenedon 25th February 2001. Speakers enthusiastic<strong>all</strong>y supported <strong>the</strong> children’s Right to a Safe Future and <strong>the</strong> need for a‘New International Political and Economic Order’.The success <strong>of</strong> <strong>the</strong> national-level sem<strong>in</strong>ar <strong>in</strong>spired me to convene <strong>the</strong> 1st International Conference on Article 51 <strong>of</strong> <strong>the</strong>Constitution <strong>of</strong> India which was held on 6th May 2001.The hearten<strong>in</strong>g response from <strong>the</strong> <strong>in</strong>ternational judicial fraternity reassured <strong>all</strong> about <strong>the</strong> support for <strong>the</strong> children’s causeamong <strong>the</strong> world judiciary. The po<strong>in</strong>t was, how to translate this support <strong>in</strong>to a movement. S<strong>in</strong>ce <strong>the</strong> <strong>Chief</strong> Justice <strong>of</strong> a Stateis <strong>the</strong> head <strong>of</strong> its Judicial w<strong>in</strong>g and commands a respectable position vis-a-vis <strong>the</strong> head <strong>of</strong> its Executive w<strong>in</strong>g or <strong>the</strong>Legislative w<strong>in</strong>g, it was decided to appeal directly to <strong>Chief</strong> <strong>Justices</strong> <strong>of</strong> <strong>the</strong> World. Therefore, I convened <strong>the</strong> 2nd InternationalConference <strong>of</strong> <strong>Chief</strong> <strong>Justices</strong> <strong>of</strong> <strong>the</strong> World on Article 51 <strong>of</strong> <strong>the</strong> Constitution <strong>of</strong> India on 23rd December 2001 and <strong>the</strong>n <strong>the</strong>3rd and 4th International Conference <strong>of</strong> <strong>Chief</strong> <strong>Justices</strong> <strong>of</strong> <strong>the</strong> World on Article 51(c) <strong>of</strong> <strong>the</strong> Constitution <strong>of</strong> India held from6th to 8th December 2002 and from 12th to 14th December, 2003, respectively, <strong>in</strong> which <strong>Chief</strong> <strong>Justices</strong>, M<strong>in</strong>isters <strong>of</strong> Lawand Justice and protagonist <strong>of</strong> peace participated. They supported <strong>the</strong> c<strong>all</strong> <strong>of</strong> students <strong>of</strong> CMS, on behalf <strong>of</strong> world’s 2billion children, for constitut<strong>in</strong>g a duly constituted World Parliament for enact<strong>in</strong>g enforceable <strong>in</strong>ternational law, so that aNew International Political and Economic order may emerge and future <strong>of</strong> worlds children born and yet to be born issafeguarded.As we <strong>all</strong> know <strong>the</strong> United Nations has also failed to fulfil <strong>the</strong> objectives for which it was primarily formed. In <strong>the</strong> five anda half decades <strong>of</strong> its existence, <strong>the</strong> UNO has seen more people die <strong>in</strong> numerous wars <strong>all</strong> over <strong>the</strong> world, than had died <strong>in</strong>both <strong>the</strong> world wars comb<strong>in</strong>ed. The UNO also saw <strong>the</strong> nuclear countries build up massive stockpiles <strong>of</strong> nuclear weapons,said to be over 36,000 warheads strong. Moreover, 80 countries have also stockpiled chemical and biological weapons.Even though <strong>the</strong> UNO has many achievements to its credit, <strong>in</strong> <strong>the</strong> ultimate analysis, one has to admit that it has f<strong>all</strong>en farshort <strong>of</strong> <strong>the</strong> expectations <strong>of</strong> its found<strong>in</strong>g fa<strong>the</strong>rs, as <strong>the</strong> basic need for a civilized society is peace and a safe future forchildren. Afghanistan and Iraq have witnessed horrible torture. This can never be overlooked, <strong>the</strong> whole world is aghast.--4--

As <strong>the</strong> consciencekeepers <strong>of</strong> mank<strong>in</strong>d and as <strong>the</strong> custodians <strong>of</strong> <strong>the</strong> welfare <strong>of</strong> humanity’s silent masses, it is for <strong>the</strong> World Judiciary to comeout and deliver a public judgement on <strong>the</strong> urgent issue <strong>of</strong> global governance. The voice <strong>of</strong> a united World Judiciary cannotbe ignored and sh<strong>all</strong> have to be heard and obeyed by <strong>all</strong>. Please unite for <strong>the</strong> sake <strong>of</strong> humanity’s survival, for <strong>the</strong> sake <strong>of</strong>world’s two billion children and for <strong>the</strong> sake <strong>of</strong> Justice for <strong>all</strong> and for <strong>the</strong> sake <strong>of</strong> a New World Order that is more just,democratic and egalitarian and that is fully capable <strong>of</strong> safeguard<strong>in</strong>g <strong>the</strong> rights <strong>of</strong> <strong>the</strong> world’s children, born and yet-to-beborn.I once aga<strong>in</strong> thank <strong>all</strong> <strong>the</strong> Hon’ble <strong>Chief</strong> <strong>Justices</strong> and Justice, em<strong>in</strong>ent personalities, legal lum<strong>in</strong>aries and <strong>all</strong> <strong>the</strong> participantsfor participat<strong>in</strong>g <strong>in</strong> this conference and hope that your voice will be heard and help br<strong>in</strong>g <strong>in</strong> a new Political and EconomicOrder and a duly constituted World Parliament for enact<strong>in</strong>g enforceable <strong>in</strong>ternational law, <strong>in</strong> <strong>the</strong> <strong>in</strong>terest <strong>of</strong> safe future forchildren, born and yet-to-be born.
