5 th International Conference <strong>of</strong> <strong>Chief</strong> <strong>Justices</strong> <strong>of</strong> <strong>the</strong> WorldAddress byHon’ble Madam Justice Anita Usacka (Latvia)Judge, International Crim<strong>in</strong>al Court, The HagueI am pleased to be here today and to address such an honourable audience. As a Judge<strong>of</strong> <strong>the</strong> International Crim<strong>in</strong>al Court, <strong>the</strong> ICC, I will talk about <strong>the</strong> contribution that <strong>the</strong>ICC can make to safeguard<strong>in</strong>g children’s right to <strong>in</strong>herit a safe and healthy ecology. Itruly believe that <strong>the</strong> ICC’s jurisdiction, its unique structure and <strong>the</strong> support it receivesfrom a large number <strong>of</strong> states, <strong>all</strong>ow it to function as an efficient tool for <strong>the</strong> protection <strong>of</strong><strong>the</strong> environment dur<strong>in</strong>g times <strong>of</strong> war.The ICC is <strong>the</strong> first ever permanent, treaty based, <strong>in</strong>ternational crim<strong>in</strong>al court establishedto promote <strong>the</strong> rule <strong>of</strong> law and ensure that <strong>the</strong> gravest <strong>in</strong>ternational crimes, such as <strong>the</strong>crime <strong>of</strong> genocide, crimes aga<strong>in</strong>st humanity, war crimes and <strong>the</strong> crime <strong>of</strong> aggression donot go unpunished. The Rome Statute establish<strong>in</strong>g <strong>the</strong> ICC was adopted <strong>in</strong> July 1998.Currently 139 States have s<strong>in</strong>ged <strong>the</strong> Statute, while 97 States have ratified it, becom<strong>in</strong>gfull members <strong>of</strong> <strong>the</strong> ICC. The ma<strong>in</strong> aims <strong>of</strong> <strong>the</strong> ICC are a) to put an end to impunity for perpetrator <strong>of</strong> <strong>the</strong> previouslymentioned crimes; b) to deter future violations; c) to br<strong>in</strong>g justice to victims; and d) to contribute <strong>in</strong> ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g andestablish<strong>in</strong>g peace, security and <strong>the</strong> well-be<strong>in</strong>g <strong>of</strong> <strong>the</strong> world.Before I talk about environmental crimes <strong>in</strong> International Humanitarian Law, I would like to share with you some considerationsregard<strong>in</strong>g <strong>the</strong> special regime <strong>in</strong> place before <strong>the</strong> ICC, tak<strong>in</strong>g <strong>in</strong>to consideration <strong>the</strong> protection <strong>of</strong> <strong>the</strong> rights and <strong>the</strong> <strong>in</strong>terests<strong>of</strong> children, who are <strong>of</strong>ten those who suffer <strong>the</strong> most as a consequence <strong>of</strong> <strong>the</strong> commission <strong>of</strong> <strong>the</strong> crimes with<strong>in</strong> <strong>the</strong> Court’sjurisdiction.The ICC has no jurisdiction over crimes committed by children under <strong>the</strong> age <strong>of</strong> 18 at <strong>the</strong> time <strong>of</strong> <strong>the</strong> <strong>all</strong>eged commission<strong>of</strong> <strong>the</strong> crime. However, <strong>the</strong> Rome Statute pays due regard to child specific issues. There are a number <strong>of</strong> crimes with<strong>in</strong> <strong>the</strong>jurisdiction <strong>of</strong> <strong>the</strong> ICC, which specific<strong>all</strong>y address <strong>the</strong> protection <strong>of</strong> children. For example, conscript<strong>in</strong>g or enlist<strong>in</strong>g childrenunder <strong>the</strong> age <strong>of</strong> fifteen years <strong>in</strong>to armed forces or groups or us<strong>in</strong>g <strong>the</strong>m to participate actively <strong>in</strong> hostilities constitutes a warcrime. In addition, <strong>the</strong> Rome Statute enumerates several crimes that, although <strong>of</strong> general character, are <strong>of</strong> particularimportance for child protection. These <strong>in</strong>clude, for example, <strong>the</strong> crime <strong>of</strong> sexual violence. Moreover, <strong>the</strong> Rome Statute, aswell as <strong>the</strong> Court’s Rules <strong>of</strong> Procedure and Evidence establish a system where children appear<strong>in</strong>g before <strong>the</strong> Court ei<strong>the</strong>ras witnesses or as mere victims receive special protection. This system is aimed at limit<strong>in</strong>g <strong>the</strong> distress children can sufferdur<strong>in</strong>g legal procedures <strong>in</strong>volv<strong>in</strong>g <strong>the</strong> crimes <strong>of</strong> which <strong>the</strong>y are victims.As it is not realistic<strong>all</strong>y feasible to ban wars from this planet, International Humanitarian Law is aimed at prevent<strong>in</strong>g means<strong>of</strong> total warfare by regulat<strong>in</strong>g <strong>the</strong> conduct <strong>of</strong> belligerent parties dur<strong>in</strong>g war.Contemporary conflicts affect not only armed forces <strong>of</strong> belligerent parties, but also civilian lives, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> lives <strong>of</strong>children, civilian <strong>in</strong>frastructure, and last, but not least, <strong>the</strong> natural environment. While <strong>in</strong>some <strong>in</strong>stances <strong>the</strong> devastation <strong>of</strong> <strong>the</strong> environment is considered as so c<strong>all</strong>ed “collateraldamage” <strong>of</strong> fight<strong>in</strong>g activities, <strong>in</strong> some cases <strong>the</strong> natural environment it is <strong>the</strong> very target<strong>of</strong> an attack.Hon’ble Madam Justice Anita Usacka (onleft), Judge, International Crim<strong>in</strong>al Court,The Hague, be<strong>in</strong>g received at LucknowAirport upon arrivalHon’ble Madam Justice Anita Usacka(Latvia), Judge, International Crim<strong>in</strong>alCourt, The Hague, address<strong>in</strong>g <strong>the</strong>ConferenceInternational law prohibits any means <strong>of</strong> warfare which are planned to cause, or may beexpected (albeit without <strong>the</strong> <strong>in</strong>tention) to cause serious damage to <strong>the</strong> natural environment.Thus it is a matter not only <strong>of</strong> protect<strong>in</strong>g <strong>the</strong> natural environment aga<strong>in</strong>st <strong>the</strong> use <strong>of</strong>weapons or techniques deliberately directed aga<strong>in</strong>st it, but also one <strong>of</strong> protect<strong>in</strong>g <strong>the</strong>natural environment itself.As I have mentioned previously, <strong>the</strong> ICC has jurisdiction over <strong>the</strong> crimes that are--35--
