Hon’ble Mr Justice N.E. Dissanayake,Judge of the Supreme Court of Sri Lankabeing presented with the ConferenceMementothey extort money from them on pain of death, abduct their children very much againsttheir will to be recruited as cadres. They eliminate anyone who disagree with them. Thevery people they claim to represent are oppressed by their tyranny. They indulge ininternational drug trafficking, human smuggling and gun running, in a very big way. Butyet some countries of the Western world sympathize with them as freedom fighters andurge poor countries like Sri Lanka, to resolve terrorism by negotiation. They tie up aidpackages to resolving this problem by negotiations. But when terrorism strikes the westernnations, like for e.g. the September 11 attack on New York, the western countries seekto fight them tooth and nail, even venturing beyond their borders. They have invadedAfghanistan and Iraq in the name of fighting terrorism and stopping manufacture ofweapons of Mass destruction, which are yet to be found. They declare that they do notnegotiate with terrorists. This is the type of contradictory positions taken by some countries, and the developing countrieslike us have to put up with.Today humanity is standing at cross-roads. One path leads to unity, peace and prosperity and the other leads to disunity,chaos and uncertainty. After the end of the so called’ cold war’ the United States tried to act as an international policemanand maintain law and order, but its actions lacked legitimacy and have been criticized sometimes even by their traditionalallies like France and Germany. However after 9/11, international terrorism has emerged as the biggest threat to thecivilized world. It is a matter of time, if not already so far, for international terrorists to lay their hands on nuclear or otherweapons of mass destruction, to threaten the life and limb of innocent human beings to achieve their desired goals. They willnot show any remorse or repentenance even after exploding such a device just to give a message to the world.There is another aspect to the peaceful well being of mankind being threatened. That is the threat to global environment,created by emissions of carbon monoxide and other harmful gases to the environment. Further, the pollution caused bydischarge of nuclear waste and other effluents to the atmosphere in callous disregard for the well being of humanity. This hasresulted in thinning of the ozone layer causing a hole in the sky exposing direct sunlight to some parts of the world which cancause skin cancer if exposed to the sun. This environmental pollution has caused global warming resulting in melting of iceon North and South poles which had in turn resulted in the rise of the sea-water levels. This can be catastrophic. In a matterof years some countries and island countries such as Maldives will go under water. Major part of the world will besubmerged.Do we have enforceable international laws to stop this catastrophe and the threat of international terrorism, which would beuniversally applicable to all the countries and people of the world? A Law has no legal sanctity if it is not enforceable, andif it does not carry a penalty for its violation, then it cannot be called a law at all. In that sense, today there is indeed nointernational law in the world. Therefore, there is total lawlessness in the world in so far as arresting international terrorismand international environmental pollution is concerned. Today, international terrorism and international environmental pollutiondemands enforceable international law, because such acts can only be curbed through enforceable international law and notby war whether between two or more countries or even a world war.Like its predecessor the League of Nations, the United Nations Organization has also failed to fulfill the objectives forwhich it was formed. In the 5 and a half decades of its existence, we have read that more people died in numerous wars allover the world than the two world wars we have faced. The U.N.O has been passively watching nuclear countries buildingup their stockpiles. Testing of Nuclear weapons on uninhabited islands causing immense environmental degradation. Thestockpile of nuclear weapons is said to be around 36000 and counting.Moreover it is said that 80 countries have also stockpiled chemical and biological weapons. The U.N.O has been a silentspectator to all this and more. In its over half a century of existence, it has merely watched by as 3/4th of the earth’s tropicalforest cover disappear. Even though U.N.O has many achievements to its credit, however in the ultimate analysis, one hasto admit that it has fallen far short of the expectations of the people of the world. Then one is reminded of the fact that--52--
world’s problems can no longer be solved by national governments. What is needed is aWorld Government.With the rapid development in science, technology and communications, the world todayhas become a global village where people from all countries have to live in close cooperationfor mutual progress, development and survival. In this changed scenario, theold mindset has become redundant and a new mindset is needed for the new millennium.The crying need of the new age is for unity of human kind and peace in the world. Thereis thus an urgent need for a legally constituted law making body i.e. World Parliament,for enacting enforceable International laws that are applicable to all the countries and thepeoples of the world. Only a legally-constituted World Parliament can ensure unity ofHon’ble Mr Justice N.E. Dissanayake,Judge of the Supreme Court of Sri Lankainteracting with Advocates of theSupreme Court of Indiahumankind and preserve world peace by banning the teaching of hatred and emphasizing teaching of world unity, worldpeace and co-existence of mankind.Therefore now, there is a crying need for Enforceable International law to safeguard the 2 billion children of the worldand the future children.
