Hon’ble Mr Justice J.P. Annandale, ActingChief Justice of Swaziland at the CivicReception in New Delhi organised by theSupreme Court Bar Association, IndiaTo be realistic, it will not happen anytime soon. To be practical, one needs to find aviable solution. It is my most respectful and humble submission to this august gatheringthat the solution does not lie in resolutions to stop international wars, atrocities, pillageand terrorism.A world parliament that can enact international law and enforce it as well through aworld court is the ideal that we strive to have established. Will the powerful nationsrelinquish their vetoes? Is it the only solution to reach our common goal? The presentand permanent solution lies hidden within us. Our Creator in His supreme wisdom hasendowed each of us with a soul and spirit that cannot be extinguished. Man also has thebrain power that far exceeds the most powerful supercomputers, the potential of whichwe are unable to appreciate. The key lies in the education of children and adults alike to embrace the values and norms ofdoing unto others as we want them to do to us.It is through this process that international law can become enforceable - over those who have been educated to appreciateand desire peace, prosperity and respect. Nations who embrace these values will not only subject themselves to it but willalso enforce it on those who do not. The time has indeed come to bequeath our children’s children with a future that wewould like to have for ourselves. We need to realise the limits of enforceable international law and concentrate on thatwhich is sustainable and viable, nurture and develop it to its full potential.The protection of human rights and the environment are but two aspects that squarely fit international enforceability.Nations, cultures, and groups who violate international legislation on these two issues can be compelled and enforced toadhere to it. The Universal Declaration of Human Rights or the African Charter cannot be allowed to remain imprisoned inthe paper on which it is written. The same applies to the protection of the world’s environment. The time has come to enactuniversal legislation by a world parliament which can be universally policed and enforced.The inevitable question is how it is to be enforced. To this, it is my respectful and most humble view that it will not only beenforceable by the stronger nations over the weaker powers, all nations, big and small,rich and poor, the people of the world must require of all powers together to enforce therecalcitrant to comply. When the perpetrators are the powerful nations themselves, itwill remain a moral indictment by the rest of the world. It is therefore that the childrenand adults of all nations need to be educated to appreciate the strong moral values andethics of respect for others. This is a core value that is taught at the City MontessoriSchool in Lucknow, India. It is the transcending of these values, which are taught to anew generation, which leads to this conference, which is held at their school in India. Itis up to us, the Chief Justices and judges of the world, to embrace their plea for a betterand safer future. It is our older generation which is obliged to convey the message to theworld: for the sake of our children’s children, the world has to wake up to reality. UnlessHon’ble Mr Justice Jacobus P. Annandale,Acting Chief Justice of Swaziland at theConferenceinternational law can be universally enforced to protect the new generations to come, the consequences will be too ghastlyto contemplate.There is hope. There is a bright future we pray to God to save us from ourselves.
