5th International Conference <strong>of</strong> <strong>Chief</strong> <strong>Justices</strong> <strong>of</strong> <strong>the</strong> WorldWelcome Address at Ist Plenary session byMr. Ratan Chandra GuptaFormer Jo<strong>in</strong>t Secretary, Law, Government <strong>of</strong> U.P., India,General secretary, City Montessori School, Lucknow and Editor, Conference Brochure.On behalf <strong>of</strong> <strong>the</strong> City Montessori School, <strong>the</strong> organisers, its teachers and students, andon my own behalf, I extend a very very warm welcome to you at this 1st Plenary session<strong>of</strong> <strong>the</strong> 5th International Conference <strong>of</strong> <strong>Chief</strong> <strong>Justices</strong> on Article 51(c) <strong>of</strong> <strong>the</strong> Constitution<strong>of</strong> India.Lordships and dignitaries, You have travelled long distances and found time out <strong>of</strong> yourbusy schedule to be here at Lucknow, to attend this Conference. This is for sure, a sign<strong>of</strong> your concern about present day problems, a sign <strong>of</strong> your aspiration for world unityand world peace and for provid<strong>in</strong>g a safe future for humanity, to <strong>the</strong> children and futuregenerations and a sign <strong>of</strong> your conviction that enforceable <strong>in</strong>ternational law enacted by aduly constituted world body or Parliament is necessary to establish order and regulateconduct <strong>of</strong> nation-states and <strong>the</strong> people. Secretary,CMS address<strong>in</strong>g <strong>the</strong> ConferenceHon’ble Sir, we have heard views <strong>of</strong> learned lum<strong>in</strong>aries <strong>in</strong> <strong>the</strong> <strong>in</strong>augural session this morn<strong>in</strong>g and <strong>in</strong> World Parliamentpresented by children about turmoil around <strong>the</strong> world and about app<strong>all</strong><strong>in</strong>g condition <strong>of</strong> children. Now, I would like to drawyour k<strong>in</strong>d attention to certa<strong>in</strong> facts. Accord<strong>in</strong>g to published figures, man made deaths <strong>in</strong> 20th century till 1970 has beenestimated at 110 millions. How many more have been killed after 1970 <strong>in</strong> various low <strong>in</strong>tensity and ethnic and civil wars,and by terrorists <strong>in</strong> <strong>the</strong> name <strong>of</strong> religion, is recent history. It has been estimated that <strong>in</strong> <strong>the</strong> past 10-12 years 2 million childrenhave died <strong>in</strong> wars and more than 4 million have become handicapped, many more have become homeless and orphans.This is heart tear<strong>in</strong>g <strong>in</strong>deed.Learned speakers and Mr Gandhi also spoke about stockpil<strong>in</strong>g <strong>of</strong> weapons <strong>of</strong> mass destruction. These bombs are amassedon <strong>the</strong> pretext <strong>of</strong> defence and ma<strong>in</strong>tenance <strong>of</strong> peace. Are <strong>the</strong>y re<strong>all</strong>y go<strong>in</strong>g to help us? Gerald Bosacker says —“We build more bombs to sadly learn,That it is not peace that weapons earn,When mounta<strong>in</strong>s melt and rivers burn”.Accord<strong>in</strong>g to U.N. figures - <strong>in</strong> <strong>the</strong> year 1995, <strong>the</strong> world spent more than 1.5 million dollars each m<strong>in</strong>ute on defence - a total<strong>of</strong> 800 billion dollars <strong>in</strong> one year - stagger<strong>in</strong>g figures, beyond comprehension. Now, aga<strong>in</strong>, accord<strong>in</strong>g to UNO, an additionalamount <strong>of</strong> 6 billion dollars a year would be needed to achieve universal basic education, an additional 13 billion dollars ayear to ensure basic health and nutrition for <strong>all</strong> and an additional 9 billion dollars a year would be required to provide cleanwater and sanitation world wide. These requirements for such basic necessities are negligible as compared to defencespend<strong>in</strong>gs. More than one billion people-majority <strong>of</strong> <strong>the</strong>m children - ei<strong>the</strong>r have no homes or live <strong>in</strong> <strong>in</strong>adequate hous<strong>in</strong>g. Ifa part <strong>of</strong> defence expenditure is consecrated to <strong>the</strong> well be<strong>in</strong>g <strong>of</strong> mank<strong>in</strong>d, it will provide succour to humanity.Millions <strong>of</strong> children have died and millions crippled and orphaned <strong>in</strong> wars-civil and ethnic, lead<strong>in</strong>g to a pa<strong>the</strong>tic life. Who isgo<strong>in</strong>g to help <strong>the</strong>m, feed <strong>the</strong>m, clo<strong>the</strong> <strong>the</strong>m, love <strong>the</strong>m and arrange to educate <strong>the</strong>m. Their condition is app<strong>all</strong><strong>in</strong>g, <strong>all</strong> createdby us - <strong>the</strong> elders. A H<strong>in</strong>di poet has aptly put his apprehension <strong>in</strong> <strong>the</strong>se words -'Mere dil ke kisi kone ma<strong>in</strong>, ek masoom sa bachcha,Baron ki dekh kar duniyan, bara hone se darta hai. 'It means ‘An <strong>in</strong>nocent child <strong>in</strong> a corner <strong>of</strong> my heart, is afraid to grow up on watch<strong>in</strong>g this world <strong>of</strong> elders’. A child with aheart so pure and simple cannot th<strong>in</strong>k <strong>of</strong> tread<strong>in</strong>g <strong>the</strong> path which we elders are tread<strong>in</strong>g. Hence afraid.There are o<strong>the</strong>r problems too, like ecological imbalance, drug traffick<strong>in</strong>g, money launder<strong>in</strong>g, HIV/AIDS, economic disparity,poverty, illiteracy, exploitation <strong>of</strong> <strong>the</strong> weaker, violence. People look to <strong>in</strong>telligentsia, honourable justices and <strong>the</strong> elite for--88--
edressal <strong>of</strong> <strong>the</strong>ir grievances. There is large scale discontentment which may boil and has to be checked. An Urdu poet hasrightly said -Mere aashiyan ka tu gam na kar, yeh jal raha hai to jala kare,Magar <strong>in</strong> hawaoon ko tu rok de, yeh sawal sare chaman ka hai.I have tried to translate it thus -“Feel not sad for my garden,If it burns, let it be,But let it not engulf <strong>the</strong> earthDestroy<strong>in</strong>g <strong>all</strong> and <strong>the</strong>e.”Sir, we have to strive to check <strong>the</strong> violence, lawlessness, terrorism and <strong>the</strong> fire <strong>of</strong> hatred, <strong>in</strong>tolerance and violence and br<strong>in</strong>g<strong>in</strong> an era <strong>of</strong> unity and love, religious tolerance, cooperation and co-existence, and not lessons <strong>in</strong> hatred and violence.Lordships, it is said that dest<strong>in</strong>y is not a matter <strong>of</strong> chance, it is a matter <strong>of</strong> choice, it is not a th<strong>in</strong>g to be waited, it is a th<strong>in</strong>gto be achieved. So, we have to make a right choice and <strong>the</strong>n strive to achieve what we want. First and foremost is <strong>the</strong>urgent need for popular recognition <strong>of</strong> need for unity and peace. World-wide awareness has to be created and media canplay an important role. Mass op<strong>in</strong>ion will <strong>the</strong>n compel politicians to part with some part <strong>of</strong> sovereignty and it will pave wayfor a duly and reasonably constituted and represented World Parliament which can enact laws. Only such laws can be<strong>in</strong>ternation<strong>all</strong>y enforceable. We <strong>all</strong> are aware that decisions even <strong>of</strong> ICJ are not b<strong>in</strong>d<strong>in</strong>g on unwill<strong>in</strong>g nations. ‘Laws notenforced cease to be laws and rights not defended may wi<strong>the</strong>r away’ said Thomas Moriarty.It is gener<strong>all</strong>y op<strong>in</strong>ed that a world order function<strong>in</strong>g through <strong>in</strong>ternational organs structured on democratic pr<strong>in</strong>ciples, wouldbe more effective <strong>in</strong> ensur<strong>in</strong>g ma<strong>in</strong>tenance <strong>of</strong> <strong>in</strong>ternational peace and security and <strong>in</strong> provid<strong>in</strong>g progressive development <strong>of</strong><strong>in</strong>ternational society. President <strong>of</strong> <strong>the</strong> Czeck Republic, Mr. Vaclav Havel, has supported <strong>the</strong> concept <strong>of</strong> a law-mak<strong>in</strong>gworld body under U.N. <strong>in</strong> his address at <strong>the</strong> Millennium Summit <strong>of</strong> <strong>the</strong> United Nations at New York on 8th September,2000. He said, I quote :“United Nations would probably have to rest on two pillars : one constituted by an assembly <strong>of</strong> equal representatives <strong>of</strong><strong>in</strong>dividual countries, resembl<strong>in</strong>g <strong>the</strong> present plenary, and <strong>the</strong> o<strong>the</strong>r consist<strong>in</strong>g <strong>of</strong> a group elected directly by <strong>the</strong> globe’spopulation <strong>in</strong> which <strong>the</strong> number <strong>of</strong> delegates represent<strong>in</strong>g <strong>in</strong>dividual nations would, thus, roughly correspond to <strong>the</strong> size <strong>of</strong><strong>the</strong> nations. These two bodies would create and guarantee global legislation.” unquote.But who is <strong>the</strong>re <strong>in</strong> U.N. to support such views. Will <strong>the</strong> veto powers agree to relegate <strong>the</strong>ir authority? The ever-closer<strong>in</strong>tegration <strong>of</strong> <strong>the</strong> expand<strong>in</strong>g European Union can set an example and lead <strong>the</strong> world away from <strong>the</strong> notion <strong>of</strong> completesovereignty <strong>of</strong> <strong>the</strong> nation states.Hon’ble Lordships, our only hope rests with you. We <strong>all</strong> must have hope, as envisaged <strong>in</strong> this Urdu couplet -Nafraton ne har taraf se gher rakha hai hamen,Jab ye deewaren girengi rasta ho jayega.I have tried to translate it thus‘Surrounded are we, by w<strong>all</strong>sOf hatred and enmity,When dismantled, it willpave way for love, peace, prosperity’.We hope <strong>the</strong> w<strong>all</strong>s will be dismantled by united efforts.Now, I want to add here that our hope rests more with ladies, who are so very capable to play roles <strong>of</strong> real benefactor, likea k<strong>in</strong>d sister, a lov<strong>in</strong>g wife, a car<strong>in</strong>g mo<strong>the</strong>r and a nurse with love abound <strong>in</strong> <strong>the</strong>ir heart for <strong>the</strong>ir children and concern for <strong>the</strong>irsafety. I appeal to <strong>the</strong>m, especi<strong>all</strong>y to those <strong>in</strong> judiciary, to raised <strong>the</strong>ir voice and play a more active role for a safe futurefor children.Lordships and dignitaries, I once aga<strong>in</strong> welcome you and pay my heartfelt gratitude to you for your ideals, convictions andaspirations for <strong>the</strong> welfare <strong>of</strong> humanity.
