<strong>the</strong> Constitution establishes (÷ II. item 148) that <strong>in</strong>ternational treaties where <strong>the</strong> AzerbaijanRepublic is participant, become <strong>in</strong>tegral component <strong>of</strong> system <strong>of</strong> our legislation.In this connection it is necessary to note, that <strong>the</strong> Constitutional Court <strong>of</strong> <strong>the</strong> AzerbaijanRepublic, courts <strong>of</strong> <strong>the</strong> general jurisdiction and o<strong>the</strong>rs <strong>in</strong>ternational bodies are based <strong>in</strong><strong>the</strong> activity on positions <strong>of</strong> <strong>the</strong> constitution accord<strong>in</strong>g to which <strong>the</strong> person, its rights andfreedom are <strong>the</strong> maximum value.Hon’ble Mr Justice Bahman Garibov,Judge, Constitutional Court <strong>of</strong>Azerbaijan receiv<strong>in</strong>g <strong>the</strong> ConferenceMementoexist<strong>in</strong>g <strong>in</strong> this or that area.In decisions <strong>the</strong> Constitutional Court leans on <strong>the</strong> conventional pr<strong>in</strong>ciples and norms <strong>of</strong><strong>in</strong>ternational law and <strong>in</strong>ternational conventions that f<strong>in</strong><strong>all</strong>y leads to <strong>the</strong> constitutional sense<strong>of</strong> norm comes to light. The court is fixed as though by <strong>in</strong>ternational legal standardsInternational norms and also <strong>the</strong> European sources <strong>of</strong> <strong>the</strong> right are used by <strong>the</strong> Constitutional Court as a necessary elementfor substantiations <strong>of</strong> <strong>the</strong> conclusions on affairs which are be<strong>in</strong>g considered.If we analyze decisions <strong>of</strong> <strong>the</strong> Constitutional Court for <strong>the</strong>ir use <strong>of</strong> <strong>in</strong>ternational norms, it will be found that practic<strong>all</strong>y <strong>all</strong> itsdecisions stand on <strong>the</strong>se documents, especi<strong>all</strong>y if it concerns questions <strong>of</strong> ma<strong>in</strong>tenance <strong>of</strong> <strong>the</strong> property right, crim<strong>in</strong>al, civillegal proceed<strong>in</strong>gs, <strong>the</strong> customs, tax, labour legislation.As is known <strong>the</strong> Azerbaijan Republic ratified <strong>the</strong> European Convention on protection <strong>of</strong> human rights and basic freedom.It is <strong>the</strong> convention admits us as a source <strong>of</strong> <strong>the</strong> right, <strong>the</strong> decision <strong>of</strong> <strong>the</strong> European Court under human rights as a source <strong>of</strong><strong>in</strong>terpretation <strong>of</strong> <strong>the</strong> right.We apply such general pr<strong>in</strong>ciples <strong>of</strong> <strong>the</strong> right as harmony or proportionality <strong>of</strong> possiblerestriction <strong>of</strong> fundamental laws, legal def<strong>in</strong>iteness and validity. The decisions <strong>of</strong> <strong>the</strong>European Court for groups <strong>of</strong> homogeneous affairs, shows that <strong>the</strong> Constitutional Court<strong>of</strong> Azerbaijan <strong>in</strong> its decisions carries an embodiment <strong>of</strong> <strong>the</strong> European approach.It is necessary to note, that now <strong>the</strong>re is a streng<strong>the</strong>n<strong>in</strong>g <strong>in</strong>teractions <strong>of</strong> different legalsystems. And <strong>the</strong>y are expression <strong>of</strong> <strong>the</strong>ir sovereignty and orig<strong>in</strong>ality. I believe that it willbe <strong>the</strong> right th<strong>in</strong>g for <strong>the</strong> twenty-first century to comb<strong>in</strong>e preservation <strong>of</strong> national legaltraditions and simultaneously with development <strong>of</strong> uniform <strong>in</strong>ternational standards.Hon’ble Mr Justice Bahman Garibov,Judge, Constitutional Court <strong>of</strong> Azerbaijanaddress<strong>in</strong>g <strong>the</strong> Press Conference with <strong>the</strong>help <strong>of</strong> an <strong>in</strong>terpreterA catastrophe may <strong>in</strong>tervene and <strong>in</strong>terrupt or destroy what is be<strong>in</strong>g done, but even<strong>the</strong>n <strong>the</strong> f<strong>in</strong>al result is sure. For, <strong>in</strong> any case, <strong>the</strong> unifications is a necessity <strong>in</strong> <strong>the</strong>course <strong>of</strong> Nature, an <strong>in</strong>evitable movement and its achievement can be safely foretold.Its necessity for <strong>the</strong> nations also is clear, for without it <strong>the</strong> freedom <strong>of</strong> sm<strong>all</strong>nations can never be safe hereafter and even large and powerful nations cannotre<strong>all</strong>y be secure.—Sri Aurob<strong>in</strong>do--73--
