The need <strong>of</strong> such forums cannotbe overestimated; Tajikistan follows <strong>the</strong> policy <strong>of</strong> peaceful coexistence, friendly relationsand non <strong>in</strong>terference <strong>in</strong> <strong>the</strong> <strong>in</strong>ternal affairs <strong>of</strong> <strong>the</strong> o<strong>the</strong>rstates. This has been proclaimed <strong>in</strong> its constitutionadopted <strong>in</strong> 1994. Time has come when <strong>the</strong> emergency<strong>of</strong> work<strong>in</strong>g out <strong>the</strong> International Law capable <strong>of</strong>ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g Enforceable Peace and Susta<strong>in</strong>ableDevelopment cannot be postponed any longer. 5th International Conference <strong>of</strong> <strong>Chief</strong> <strong>Justices</strong> <strong>of</strong> <strong>the</strong> WorldWelcome Address at <strong>the</strong> Second Plenary session byHon’ble Mr Justice Kamleshwar NathFormer Judge, Allahabad High Court, IndiaI have <strong>the</strong> privilege <strong>of</strong> welcom<strong>in</strong>g you <strong>all</strong> to this session <strong>of</strong> <strong>the</strong> momentous conference on<strong>the</strong> World’s most important need. On <strong>the</strong> cover page <strong>of</strong> <strong>the</strong> programme <strong>of</strong> this conference,<strong>the</strong> appeal <strong>of</strong> 29,000 CMS students on behalf <strong>of</strong> world’s 2 billion children c<strong>all</strong>s aloud:“WE WANT A UNITED AND PEACEFUL WORLD”.Ladies and gentlemen, Is <strong>the</strong>re a s<strong>in</strong>gle person <strong>in</strong> this august ga<strong>the</strong>r<strong>in</strong>g who does not jo<strong>in</strong><strong>in</strong> this Appeal? Let him raise his hand. Everyone wants peace – peace at home, peace <strong>in</strong>society, peace among nations, peace on Mo<strong>the</strong>r Earth. Without peace life is not worthliv<strong>in</strong>g; and yet we have conflicts <strong>all</strong> around. The world is sitt<strong>in</strong>g on a gun-powder kegwith more than 12,000 nuclear warheads with USA, 22,000 with Russia, 500 withFrance and so on. One wrong move followed by a retaliation may br<strong>in</strong>g doom! At asm<strong>all</strong>er scale, <strong>the</strong>re are world-wide acts <strong>of</strong> terrorism. India is a victim s<strong>in</strong>ce generations,Hon’ble Mr Justice Kamleshwar Nath,Former Judge, Allahabad High Court,India address<strong>in</strong>g <strong>the</strong> Conferenceand <strong>the</strong> worst part is that it has cynical foreign support. It nations support violence, how can <strong>the</strong>re be peace! My Lords andfriends, would you not like to f<strong>in</strong>d ways and means to stop this mean<strong>in</strong>gless violence? Peace cannot be won by War; thatwould be a contradiction <strong>in</strong> terms. It can be won only by mutual understand<strong>in</strong>g and a spirit <strong>of</strong> give and take. <strong>Judges</strong> are <strong>the</strong>ideal persons to perform this onerous task.Concepts are co<strong>in</strong>ed, even dug out from <strong>the</strong> pages <strong>of</strong> scriptures, to justify conflicts – so-c<strong>all</strong>ed ‘wars <strong>of</strong> <strong>in</strong>dependence’even where <strong>the</strong>re is no subjugation, religious <strong>in</strong>tolerance based on self-styled superiority <strong>of</strong> one doctr<strong>in</strong>e over <strong>the</strong> o<strong>the</strong>r –<strong>the</strong> Kafir/Jehad syndrome and, worst <strong>of</strong> <strong>all</strong>, <strong>the</strong> class psychology, <strong>all</strong> give birth to a mental frame lead<strong>in</strong>g to conflicts whichescalate <strong>in</strong>to m<strong>in</strong>i-wars. All <strong>the</strong>se c<strong>all</strong> for redress.The idea <strong>of</strong> a World Parliament, a World Government, with powers to implement an “Enforceable International Law”, soassiduously propagated by <strong>the</strong> CMS, Lucknow, through 4 earlier International Conferences, like <strong>the</strong> current 5th one, isworth deep consideration <strong>of</strong> <strong>Judges</strong> and Jurists <strong>of</strong> <strong>the</strong> World. Hurdles <strong>the</strong>reto lurk <strong>in</strong> <strong>the</strong> m<strong>in</strong>ds <strong>of</strong> politicians whoseparamount consideration is self-<strong>in</strong>terest, <strong>of</strong>ten propped up as National Interest. Indeed national <strong>in</strong>terests will have to blendwith <strong>in</strong>ternational <strong>in</strong>terest. There<strong>in</strong> lies <strong>the</strong> function <strong>of</strong> <strong>Judges</strong>: Fairness, Justice, Human Dignity and Equality must be madeto prevail not merely among <strong>in</strong>dividuals but also among nations. Even a fair International Law, may not be enforced <strong>in</strong> <strong>the</strong>face <strong>of</strong> <strong>the</strong> self-<strong>in</strong>terest <strong>of</strong> powerful nations and <strong>the</strong>ir stooges. You may take <strong>the</strong> horse to water, but you cannot make itdr<strong>in</strong>k. There is <strong>the</strong> rub! How to achieve <strong>the</strong> ‘sumum bonum’ is <strong>the</strong> uphill task <strong>of</strong> this conference. Sarve BhavantuSukh<strong>in</strong>ah Sarve Santu niramaya, sarve bhadrani pashyantu maa kashchid dukh bhagbhavetah has been <strong>the</strong>Ancient ideal <strong>of</strong> H<strong>in</strong>du Philosophy. May everyone be happy, free from disease; may everyone see good <strong>in</strong> o<strong>the</strong>rs, maynobody suffer from grief.To what extent this high aspiration can be achieved, I cannot say; but one outstand<strong>in</strong>g fact sh<strong>in</strong>es out. The CMScha<strong>in</strong> <strong>of</strong> Schools, under <strong>the</strong> untir<strong>in</strong>g effort <strong>of</strong> Jagdish Gandhi, his illustrious wife Bharati Gandhi and <strong>the</strong> devoted staff <strong>of</strong> <strong>the</strong>School have educated and tra<strong>in</strong>ed <strong>the</strong>ir students, year after year, <strong>in</strong>to <strong>the</strong> ideals and practices <strong>of</strong> fraternity, respect forhumanity, and character <strong>of</strong> high order which will make <strong>the</strong>m and <strong>the</strong> generations to come to be worthy <strong>of</strong> our GreatMo<strong>the</strong>rland – Bharat Mata. No <strong>in</strong>dividual, no Institution has ever endeavoured with such devotion and tenacious <strong>in</strong>tensityas <strong>the</strong> CMS <strong>in</strong> br<strong>in</strong>g<strong>in</strong>g <strong>the</strong> World Community on to a common platform to fulfil <strong>the</strong> aspiration for a ‘UNITED ANDPEACEFUL WORLD’.Once aga<strong>in</strong>, on behalf <strong>of</strong> myself and CMS Family, I welcome you <strong>all</strong> to this conference with best wishes forsuccess.--77--
