DesaiFormer <strong>Chief</strong> Justice <strong>of</strong> Uttaranchal High Court, IndiaChairman <strong>of</strong> Preparatory Committee <strong>of</strong> <strong>the</strong> ConferenceThe jurisprudence <strong>of</strong> Article 51, it were <strong>the</strong>n used as most rhetoric than <strong>the</strong> realistic. Thearticle mandates <strong>the</strong> state to endure to foster respect for International Law. It was <strong>the</strong>nnever believed to be a reality but <strong>in</strong> <strong>the</strong> course <strong>of</strong> time that article has become a source <strong>of</strong><strong>in</strong>spiration for this conference and now this conference is with <strong>the</strong> objective to make <strong>the</strong>mandate given by <strong>the</strong> constitution to <strong>the</strong> Indian subcont<strong>in</strong>ent as a global pursuit. Whiletak<strong>in</strong>g note we have realization which is a predicament <strong>of</strong> <strong>the</strong> day that on one planet wehave got many or several worlds. We have got different purpose <strong>of</strong> liv<strong>in</strong>g but we havelost <strong>the</strong> purpose <strong>of</strong> life. We have developed a toxic aptitude for Veto power and <strong>in</strong> ademocratic setup we have got undemocratic tendencies. To accomplish this objective, <strong>the</strong> conference has traced to develop universal values and globalunderstand<strong>in</strong>g. To reach this goal <strong>the</strong> conference has earlier addressed on <strong>the</strong> World Parliament, World Judiciary, andWorld Government that is a s<strong>in</strong>gle statehood. In 2002 <strong>the</strong> Lucknow Declaration adopted<strong>in</strong> <strong>the</strong> World <strong>Chief</strong> <strong>Justices</strong> Conference, has prayed for World Parliament to enact‘Enforceable International Law’ but <strong>the</strong> conference is not unm<strong>in</strong>dful that this civilized worldhas a tremendous fasc<strong>in</strong>ation for law but hardly <strong>in</strong> a mental aptitude to accept <strong>the</strong>responsibility <strong>of</strong> <strong>the</strong> law. World Community today isflooded with too many laws and it is said about India thatIndia is highly legislative country. It is said that noth<strong>in</strong>g isHon’ble Mr <strong>Justices</strong> Ashok A. Desai,Former <strong>Chief</strong> Justice <strong>of</strong> UttaranchalHigh Court, India be<strong>in</strong>g garlandedmore fertile <strong>in</strong> <strong>the</strong> subcont<strong>in</strong>ent than <strong>the</strong> Legislature andnoth<strong>in</strong>g is more durable <strong>in</strong> this country than <strong>the</strong> litigation<strong>in</strong> <strong>the</strong> court. The plight <strong>of</strong> <strong>the</strong> world community is that<strong>the</strong>y have got too many laws, too many lawyers, too manylaw courts but agony is <strong>the</strong>y have got a too little justice. We have enough privateInternational Laws, Public International Laws but regime <strong>of</strong> International Law is a dist<strong>in</strong>ctdream. Steven Doorman has once said that ‘A process <strong>of</strong> <strong>in</strong>tegrated law is on decl<strong>in</strong>e’.This conference takes note that <strong>the</strong> performance <strong>of</strong> any law, and <strong>in</strong> that matter even<strong>in</strong>ternational law, cannot be left to <strong>the</strong> words <strong>of</strong> law and power to punish. We have todevelop along with <strong>the</strong> law, strong will <strong>of</strong> <strong>the</strong> people, courage <strong>of</strong> conviction andcommitment to <strong>the</strong> truth and honesty. On <strong>the</strong>se pillars we can built up <strong>the</strong> mean<strong>in</strong>gfulrhythm <strong>of</strong> International Law.Hon’ble Mr <strong>Justices</strong> Ashok A.
