In the example in Figure 20 the two rules are identical in thatrange of B (but they do not need to be), so the two rules can be considered a single, integrated,target control rule for all values of B.5.2.4 Measures to Prevent Overfishing and Overfished StocksThe control rules specify how fishing mortality will be controlled in response to observedchanges in stock biomass or its proxies. Implicitly associated with those control rules aremanagement actions that would be taken in order to manipulate fishing mortality according tothe rules. In the case of a fishery which has been determined to be “approaching an overfishedcondition or is overfished,” MSA §303(a)(10) requires that the FMP “contain conservation andmanagement measures to prevent overfishing or end overfishing and rebuild the fishery.”5.3 Management Program for Bottomfish and Seamount Groundfish Fisheries5.3.1 Management Areas and Sub-areasThe fishery management area in the <strong>Hawaii</strong>an Islands <strong>FEP</strong> is divided into three sub-areas:(1) Main <strong>Hawaii</strong>an Islands (MHI) means the EEZ of the <strong>Hawaii</strong>an Islands Archipelago lying tothe east of 161° W longitude.(2) Northwestern <strong>Hawaii</strong>an Islands (NWHI) means the EEZ of the <strong>Hawaii</strong>an Islands Archipelagolying to the west of 161° W. Midway Island is treated as part of the Northwestern <strong>Hawaii</strong>anIslands Subarea.(i) Ho’omalu Zone means that portion of the EEZ around the NWHI west of 165°W.longitude.(ii) Mau Zone means that portion of the EEZ around the NWHI between 161°' Wlongitude and 165° W longitude.(3) Hancock Seamount means that portion of the EEZ in the Northwestern <strong>Hawaii</strong>an Islands westof 180°00' W longitude and north of 28°00' N latitude.5.3.2 Permit and Reporting RequirementsThe Magnuson-Stevens <strong>Fishery</strong> Conservation and Management Act (Magnuson-Stevens Act),requires the registration of individuals who engage in recreational fishing. Effective October 1, 2008, aFederal bottomfish permit is required for vessel owners and fishermen to conduct vessel-basednon-commercial fishing for any bottomfish management unit species in Federal waters aroundthe MHI (except customers of charter fishing trips). The operators and owners of noncommercialfishing vessels must submit daily Federal logbooks that document bottomfish fishingeffort and catch for each fishing trip. <strong>Fishery</strong> participants have the option of using NMFSapproved electronic logbooks in lieu of paper logbooks.To date, there are no Federal permitting or reporting requirements for commercial vesseloperators targeting or harvesting bottomfish MUS in the MHI; however, commercial fisheryparticipants (those who sell at least one fish during the year) must obtain commercial marinelicenses from HDAR and submit monthly fishing reports (this reporting requirement isreinforced by a Federal regulation requiring compliance with State reporting requirements).138
