<strong>Hawaii</strong>. In addition, the holder of a new limited access permit must own at least a 50-percentshare in the vessel that the permit would cover.The operator of any fishing vessel must maintain on board the vessel an accurate and completerecord of catch, effort, and other data on report forms provided by the NMFS RegionalAdministrator. All information specified on the forms must be recorded on the forms within 24hours after the completion of each fishing day. The original logbook form for each day of thefishing trip must be submitted to the Regional Administrator within 72 hours of each landing ofcrustacean management unit species. Each form must be signed and dated by the fishing vesseloperator. <strong>Fishery</strong> participants have the option of using NMFS approved electronic logbooks inlieu of paper logbooks.The operator of any fishing vessel must submit to the Regional Administrator, within 72 hours ofoffloading of crustacean management unit species, an accurate and complete sales report on aform provided by the Regional Administrator. The form must be signed and dated by the fishingvessel operator.The operator of any fishing vessel must attach packing or weigh-out slips provided to theoperator by the first-level buyer(s), unless the packing or weigh-out slips have not been providedin time by the buyer(s). Upon request, any first-level buyer must immediately allow anauthorized officer and any employee of NMFS designated by the Regional Administrator, toaccess, inspect, and copy all records relating to the harvest, sale, or transfer of crustaceanmanagement unit species taken by vessels that have permits. The information must include, butis not limited to the name of the vessel involved in each transaction and the owner or operator ofthe vessel; the amount, number and size of each management unit species involved in eachtransaction; and prices paid by the buyer and proceeds to the seller in each transaction.5.4.3 ProhibitionsIn Permit Area 1, it is unlawful for any person to:(1) Fish for, take, or retain lobsters without a limited access permit; by methods other thanlobster traps or by hand for lobsters; from closed areas for lobsters; during a closed season; afterthe closure date, and until the fishery opens again in the following calendar year; or in a lobstergrounds after closure of that grounds.(2) Fail to report before landing or offloading.(3) Fail to comply with any protective measures.(4) Leave a trap unattended in the Management Area.(5) Maintain on board the vessel or in the water more than 1,200 traps per fishing vessel, ofwhich no more than 1,100 can be assembled traps.(6) Land lobsters taken in Permit Area 1 after the closure date until the fishery opens again thefollowing year.(7) Refuse to make available any required records to an authorized officer and employee ofNMFS designated by the Regional Administrator for inspection and copying.(8) Possess on a fishing vessel that has a limited access permit any lobster trap in CrustaceansPermit Area 1 when fishing for lobster is prohibited.152
