Live black coralharvested from any precious corals permit area must have attained either a minimum stemdiameter of 1 inch (2.54 cm), or a minimum height of 48 inches (122 cm).5.5.5 Area RestrictionsFishing for coral on the WestPac Bed is not allowed. The specific area closed to fishing is allwaters within a 2-nm radius of the midpoint of 23°18.0' N latitude, 162°35.0' W longitude.5.5.6 Gear RestrictionsOnly selective gear may be used to harvest coral from any precious corals permit area. Selectivegear means any gear used for harvesting corals that can discriminate or differentiate betweentype, size, quality, or characteristics of living or dead corals.5.5.7 Framework ProceduresEstablished management measures may be revised and new management measures may beestablished and/or revised through rulemaking if new information demonstrates that there arebiological, social, or economic concerns in a precious corals permit area. By June 30 of eachyear, the <strong>Council</strong>-appointed Precious Corals Plan Team will prepare an annual report on thefishery in the management area. The report will contain, among other things, recommendationsfor <strong>Council</strong> action and an assessment of the urgency and effects of such action(s).Established measures are management measures that, at some time, have been included inregulations implementing the FMP, and for which the impacts have been evaluated in<strong>Council</strong>/NMFS documents in the context of current conditions. According to the frameworkprocedures of Amendment 3 to the FMP, the <strong>Council</strong> may recommend to the RegionalAdministrator that established measures be modified, removed, or re-instituted. Suchrecommendation will include supporting rationale and analysis and will be made after advancepublic notice, public discussion, and consideration of public comment. NMFS may implementthe <strong>Council</strong>’s recommendation by rulemaking if approved by the Regional Administrator.New measures are management measures that have not been included in regulationsimplementing the FMP, or for which the impacts have not been evaluated in <strong>Council</strong>/NMFSdocuments in the context of current conditions. Following the framework procedures ofAmendment 3 to the FMP, the <strong>Council</strong> will publicize, including by a Federal Register document,and solicit public comment on, any proposed new management measure. After a <strong>Council</strong>meeting at which the measure is discussed, the <strong>Council</strong> will consider recommendations andprepare a Federal Register document summarizing the <strong>Council</strong>’s deliberations, rationale, andanalysis for the preferred action and the time and place for any subsequent <strong>Council</strong> meeting(s) toconsider the new measure. At a subsequent public meeting, the <strong>Council</strong> will consider publiccomments and other information received before making a recommendation to the RegionalAdministrator about any new measure. If approved by the Regional Administrator, NMFS mayimplement the <strong>Council</strong>’s recommendation by rulemaking.162
