The measures in this <strong>FEP</strong> are consistent with National Standard 4 because they do notdiscriminate between residents of different States or allocate fishing privileges among fisheryparticipants.National Standard 5 states that conservation and management measures shall, where practicable,consider efficiency in the utilization of fishery resources; except that no such measure shall haveeconomic allocation as its sole purpose.The measures in this <strong>FEP</strong> are consistent with National Standard 5 because they do not require orpromote inefficient fishing practices nor is economic allocation among fishery participants theirsole purpose.National Standard 6 states that conservation and management action shall take into account andallow for variations among, and contingencies in, fisheries, fishery resources, and catches.The measures in this <strong>FEP</strong> are consistent with National Standard 6 because they establish amanagement structure that is explicitly place based to promote consideration of the local factorsaffecting fisheries, fishery resources, and catches.National Standard 7 states that conservation and management measures shall, where practicable,minimize costs and avoid unnecessary duplication.The measures in this <strong>FEP</strong> are consistent with National Standard 7 because they encourage thedevelopment of management measures that are tailored for the specific circumstances existing inthe <strong>Hawaii</strong> Archipelago.National Standard 8 states that conservation and management measures shall, consistent with theconservation requirements of this Act (including the prevention of overfishing and rebuilding ofoverfished stocks), take into account the importance of fishery resources to fishing communitiesin order to (A) provide for the sustained participation of such communities, and (B) to the extentpracticable, minimize adverse economic impacts on such communities.The measures in this <strong>FEP</strong> are consistent with National Standard 8 because they include explicitmechanisms to promote the participation of fishing communities in the development andimplementation of future management measures in the <strong>Hawaii</strong> Archipelago.National Standard 9 states that conservation and management measures shall, to the extentpracticable, (A) minimize bycatch and (B) to the extent bycatch cannot be avoided minimize themortality of such bycatch.The measures in this <strong>FEP</strong> are consistent with National Standard 9 because the bycatch provisionscontained within the <strong>Council</strong>’s previous FMPs which were previously determined to beconsistent with National Standard 9 are maintained in this <strong>FEP</strong> without change, and no newmeasures have been added that would increase bycatch or bycatch mortality.226
