There are no MSA recognized catch and release fishery management programs inthe Hawaii Archipelago.27 Pursuant to the Endangered Species Act, NMFS may require fishing vessels in fisheries identified through anannual determination process to carry Federal observers (72 FR 43176, August 3, 2007).224
8.2.10 Description of Fishery SectorsChapter 4 of this document describes the different demersal fishery sectors in the HawaiiArchipelago.8.2.11 National Standards for Fishery Conservation and ManagementNational Standard 1 states that conservation and management measures shall prevent overfishingwhile achieving, on a continuing basis, the optimum yield from each fishery for the United Statesfishing industry.The measures in this FEP are consistent with National Standard 1 because they emphasizemanaging the fisheries in a sustainable manner to best obtain optimum yield. The measures inthis FEP are a result of the consolidation of the Council’s previous four species-based demersalFMPs (Bottomfish and Seamount Groundfish, Coral Reef Ecosystems, Crustaceans, andPrecious Corals) into one place-based Hawaii Archipelago Fishery Ecosystem Plan. Thereference points and control rules for species or species assemblages within those four FMPs aremaintained in this FEP without change.National Standard 2 states that conservation and management measures shall be based upon thebest scientific information available.The measures in the fisheries managed through this FEP are consistent with National Standard 2because they are based on the best scientific information available. Stock assessments and dataon catches, catch rates, and fishing effort are compiled by the NMFS’ Pacific Islands FisheriesScience Center and have gone through rigorous review processes. In addition, managementdecisions have complied with environmental laws including NEPA, which ensures that thepublic is part of the data review process.National Standard 3 states that, to the extent practicable, an individual stock of fish shall bemanaged as a unit throughout its range, and interrelated stocks of fish shall be managed as a unitor in close coordination.The measures in this FEP are consistent with National Standard 3 because they promote thecoordinated management of the full range of demersal species known to be present within EEZwaters around the Hawaii Archipelago.National Standard 4 states that conservation and management measures shall not discriminatebetween residents of different States. If it becomes necessary to allocate or assign fishingprivileges among various United States fishermen, such allocation shall be (A) fair and equitableto all such fishermen; (B) reasonably calculated to promote conservation; and (C) carried out insuch manner that no particular individual, corporation, or other entity acquires an excessive shareof such privileges.225
