(9) Possess on a fishing vessel that has a limited access permit any lobster trap in CrustaceansPermit Area 1 VMS Subarea when fishing for lobsters is prohibited.(10) Interfere with, tamper with, alter, damage, disable or impede the operation of a VMS unit orto attempt any of the same while engaged in the Permit Area 1 fishery or to move or remove aVMS unit while engaged in the Permit Area 1 fishery without first notifying the NMFS RegionalAdministrator.(11) Make a false statement, oral or written, to the NMFS Regional Administrator or anauthorized officer, regarding the certification, use, operation, or maintenance of a VMS unit usedin the fishery.(12) Fail to allow an authorized officer to inspect and certify a VMS unit used in the fishery.(13) Possess, on a fishing vessel that has a limited access permit, any lobster trap in a lobstergrounds that is closed, unless the vessel has an operational VMS unit, certified by NMFS, onboard.In Permit Area 2, it is unlawful for any person to:(1) Fish for, take, or retain lobsters by methods other than lobster traps or by hand; or during aclosed season.(2) Retain or possess on a fishing vessel any lobster taken in Permit Area 2 that is less than theminimum size.(3) Possess on a fishing vessel any lobster or lobster part taken in Permit Area 2 in a conditionwhere the lobster is not whole and undamaged.(4) Retain or possess on a fishing vessel, or remove the eggs from, any egg-bearing lobster.(5) Possess on a fishing vessel that has a permit for Permit Area 2 any lobster trap in Permit Area2 when fishing for lobster in the main <strong>Hawaii</strong>an Islands is prohibited during the months of May,June, July and August.In any Permit Area, it is unlawful for any person to:(1) Fish for, take, or retain deepwater shrimp without a permit.(2) Falsify or fail to make, keep, maintain, or submit Federal reports and records of harvests ofdeepwater shrimp.5.4.4 NotificationsVessel operators must report not less than 24 hours, but not more than 36 hours, before landing,the port, the approximate date and the approximate time at which spiny and slipper lobsters willbe landed. They must also report not less than six hours, and not more than twelve hours, beforeoffloading, the location and time that offloading spiny and slipper lobsters will begin. TheRegional Administrator will notify permit holders of any change in the reporting method andschedule required at least 30 days prior to the opening of the fishing season.5.4.5 Size RestrictionsIn Permit Area 2 only spiny lobsters with a carapace length of 8.26 cm or greater may beretained and any lobster with a punctured or mutilated body, or a separated carapace and tail,may not be retained. In addition, a female lobster of any size may not be retained if it is carryingeggs externally and eggs may not be removed from female lobsters.153
