EnforcementThe code includes the requirement that proposed developments meet the adopted LOS standards and alsomeet the minimum concurrency management measures. (Sec. 23-37) It is the responsibility <strong>of</strong> the ownerand permit holder to comply with and complete the work in accordance with the provisions <strong>of</strong> the codesand ordinances applicable to the permit (Sec. 19-97) (Sec. 19-127) (Sec. 23-58).Typically, the enforcement <strong>of</strong> the permit conditions is through the Building Department’s CodeEnforcement Division, via withholding the Certification <strong>of</strong> Occupancy (except in the case <strong>of</strong> single familyresidences) until the building <strong>of</strong>ficial receives approval and concurrence from the <strong>City</strong>’s civil engineerthat the permit conditions have been met (Sec. 19-147) (Sec. 23-141 (5)). In the event that land is clearedwithout a permit, the project will be deemed to be in violation and the permit will be denied until finaldisposition <strong>of</strong> the issue. If the applicant is found guilty <strong>of</strong> work without a permit, permission forcontinued land clearing <strong>of</strong> the site will be denied and future permits within the <strong>City</strong> will be denied for aperiod <strong>of</strong> one year. (Sec. 23-283).Chapter 17 Utilities outlines the enforcement rights as they relate to addressing illicit connections to the<strong>City</strong>’s MS4. This enforcement is typically via verbal or written notification requiring the immediateremoval <strong>of</strong> the connection but may also result in enforcement by violation notice or fine issued by CodeEnforcement personnel.C. Private stormwater system regulations and monitoringThe existing municipal code has a number <strong>of</strong> references to requirements for upkeep <strong>of</strong> privately ownedstormwater systems. The private landowner has full responsibility for the maintenance and upkeep <strong>of</strong> itsdrainage system including swales and lakes (Sec. 23-141, Sec. 23-301(2)(d) and Sec. 25-252). In order toprovide water quality treatment, the code requires that littoral zones be established within private waterbodies and a management plan be developed (Sec. 23-301(2)(f)). So that the <strong>City</strong> may monitor thecondition the code allows for the <strong>City</strong> to access private lakes.
