<strong>City</strong> <strong>of</strong> <strong>Boca</strong> <strong>Raton</strong> Regulatory Information SummaryTotal Maximum Daily Load Allocation ProgramThe Boynton Canal was included as an impaired water in the 1998 303(d) list for Dissolved Oxygen,Coliforms, Nutrients and Biochemical Oxygen Demand, but subsequent FDEP review <strong>of</strong> fisheries datacollected and reported by the Florida Fish and Wildlife Commission (FWC) was found sufficient todemonstrate that aquatic life use support was being met. This determination has lead to the delisting <strong>of</strong>the Boynton Canal. Coordination with the FWC and other existing agencies may prove beneficial due tothe field experience, techniques, and reporting history <strong>of</strong> these agencies.Although previous studies have been accepted by FDEP as evidence <strong>of</strong> non-impairment, FWC proceduresdo not necessarily coincide with the Rule established standard operating procedures for data acquisition.FDEP is therefore not obligated to accept the findings <strong>of</strong> reports <strong>of</strong> this type as justification for delistingbut has demonstrated a willingness to do so. The Rule allows FDEP the discretion to make individualdeterminations depending on the reason for listing, but conducting these studies would provide necessaryscientific indications <strong>of</strong> waterbody health.Along with experience, facilities, techniques, and specialized equipment for sampling, state or otheragencies performing these kinds <strong>of</strong> environmental evaluations may have an established impartiality whichlends credibility to their conclusions. Cooperative partnerships with these agencies for the performance<strong>of</strong> additional studies may become useful for the delisting <strong>of</strong> water bodies where possible, and are far lessexpensive than contracting with private firms.
