ACTING CHAIRMAN SKINNER: Mr. Harmon, <strong>you</strong> <strong>have</strong><br />

raised a sUbstantial issue which the staff has briefed<br />

f<strong>or</strong> the Commission. It's the opinion of the Commission<br />

th<strong>at</strong>, given the imp<strong>or</strong>tance of constitutional rights f<strong>or</strong><br />

all Americans, it would not be <strong>at</strong> <strong>this</strong> point in the<br />

purview of the Commission to rule on whether <strong>or</strong> not <strong>this</strong><br />

witness h&s waived his constitutional rights. Th<strong>at</strong><br />

should be f<strong>or</strong> a Judge of the United St<strong>at</strong>es District<br />

Court f<strong>or</strong> the N<strong>or</strong>thern District of Illinois.<br />

It is our direction th<strong>at</strong> <strong>you</strong> review his testi­<br />

mony and take <strong>this</strong> m<strong>at</strong>ter up with a judge and get a<br />

determin<strong>at</strong>ion as to whether <strong>or</strong> not Mr. Presser's<br />

multi-page st<strong>at</strong>ement, which he, in the presence of<br />

counsel, submitted to the Commission, whether th<strong>at</strong> does<br />

in fact constitute a waiver of his constitutional rights<br />

and should be, theref<strong>or</strong>e, <strong>or</strong>dered to answer questions<br />

concerning those areas in his st<strong>at</strong>ement bef<strong>or</strong>e <strong>this</strong><br />

Commission.<br />

With th<strong>at</strong> in mind, I'm going to continue Mr.<br />

Presser's subpoena bef<strong>or</strong>e <strong>this</strong> Commission until a l<strong>at</strong>er<br />

d<strong>at</strong>e, direct the staff to consult with the Commission<br />

<strong>at</strong> the concl<strong>us</strong>ion of today's hearings to disc<strong>us</strong>s<br />
