Petr Hrachovec: The Fifth Year of Appellate Review in Criminal<br />
Procedure<br />
The article deals widely with practical problems of<br />
appellate review in criminal procedure. It discusses<br />
typical situations with threatening errors of an attorney<br />
upon filing this extraordinary relief, for example<br />
which judgment should be contested and in which extent,<br />
what legal cause for appellate review should be<br />
stated and which material objections may be subordinate<br />
thereto etc. The author also mentions various<br />
possibilities of losing the time limit for appellate review.<br />
Because appellate review is formalized considerably<br />
and because attorneys have a sort of monopoly<br />
for elaboration thereof on behalf of accused persons,<br />
the article is beneficial for attorneys in case<br />
that they intend to apply for an appellate review as<br />
a real base for review of final judgments by the Supreme<br />
Court.<br />
Lukáš Michna: Order of Payment from Bank Account as a New<br />
Method of Judgment Enforcement and Execution – Certain Contentious<br />
Provisions<br />
With effect from 14 May 2006 the Czech law recognizes<br />
a new method of judgment enforcement and<br />
execution stating an obligation to pay, the so-called<br />
order of payment from bank account. The author in<br />
his article discusses various aspects of the new legislation<br />
and specifies problems related thereto. Attention<br />
is paid to theoretical issues, e.g. the nature of<br />
the institute of payment order, as well as to practical<br />
aspects, e.g. problems of service of payment orders,<br />
possibilities to contest a payment order by remedial<br />
measures or procedures upon payment to the beneficiary.<br />
The article has a form of a discussion, it criticizes<br />
the new legislation and in the end recommends<br />
necessary legislative amendments in order to make<br />
the institute of order of payment from bank account<br />
practicable.<br />
Pavel Vantuch: When Telephone Interception May Be Used as<br />
Evidence against the Accused<br />
Telephone calls interception and records of telephone<br />
communication are frequently used in criminal prosecution<br />
cases now. Interception records acquired before<br />
commencement of the criminal prosecution are<br />
often the cause of the criminal prosecution of the<br />
accused or more co-accused persons. However, this<br />
occurs also in cases when the judge issued an order<br />
to intercept and record telephone communication due<br />
to an extremely serious wilful crime or another wilful<br />
crime, the prosecution whereof was ordered by a published<br />
international convention (s. 88 (1), Criminal Code).<br />
Nevertheless, the criminal prosecution is after<br />
many months commenced on the basis of a less serious<br />
wilful offence, prosecution whereof is not required<br />
by a published international convention. May<br />
such interceptions and records of telephone calls be<br />
used as evidence in the case? The author tries to answer<br />
this question in the article.<br />
Michal Králík: Legal Liability of Skiers for Injuries on Ski Slopes<br />
The article dealing with legal liability of skiers for injuries<br />
on ski slopes informs readers about basic rules<br />
and principles followed upon assessment of such issues,<br />
with emphasis on the rules issued by the International<br />
Ski Federation (FIS). Its maps the very scarce<br />
case law and doctrine developments in this sphere<br />
in the Czech Republic and discusses solutions to<br />
the stated issues in the Swiss, German, French and<br />
English legislation developments, because literature<br />
and court practice of these countries pay long-term<br />
and considerable attention to the mentioned aspects.<br />
The stated comparative view may inspire and benefit<br />
the Czech specialized literature (almost missing so<br />
far) and court practice in this sphere. Conclusions stated<br />
in the article stress that also skiers are not<br />
exempt from any criminal and civil liability for injuries<br />
occurred in relation to skiing.
