Petr Hrachovec: The Fifth Year of Appellate Review in Criminal
Procedure
The article deals widely with practical problems of
appellate review in criminal procedure. It discusses
typical situations with threatening errors of an attorney
upon filing this extraordinary relief, for example
which judgment should be contested and in which extent,
what legal cause for appellate review should be
stated and which material objections may be subordinate
thereto etc. The author also mentions various
possibilities of losing the time limit for appellate review.
Because appellate review is formalized considerably
and because attorneys have a sort of monopoly
for elaboration thereof on behalf of accused persons,
the article is beneficial for attorneys in case
that they intend to apply for an appellate review as
a real base for review of final judgments by the Supreme
Court.
Lukáš Michna: Order of Payment from Bank Account as a New
Method of Judgment Enforcement and Execution – Certain Contentious
Provisions
With effect from 14 May 2006 the Czech law recognizes
a new method of judgment enforcement and
execution stating an obligation to pay, the so-called
order of payment from bank account. The author in
his article discusses various aspects of the new legislation
and specifies problems related thereto. Attention
is paid to theoretical issues, e.g. the nature of
the institute of payment order, as well as to practical
aspects, e.g. problems of service of payment orders,
possibilities to contest a payment order by remedial
measures or procedures upon payment to the beneficiary.
The article has a form of a discussion, it criticizes
the new legislation and in the end recommends
necessary legislative amendments in order to make
the institute of order of payment from bank account
practicable.
Pavel Vantuch: When Telephone Interception May Be Used as
Evidence against the Accused
Telephone calls interception and records of telephone
communication are frequently used in criminal prosecution
cases now. Interception records acquired before
commencement of the criminal prosecution are
often the cause of the criminal prosecution of the
accused or more co-accused persons. However, this
occurs also in cases when the judge issued an order
to intercept and record telephone communication due
to an extremely serious wilful crime or another wilful
crime, the prosecution whereof was ordered by a published
international convention (s. 88 (1), Criminal Code).
Nevertheless, the criminal prosecution is after
many months commenced on the basis of a less serious
wilful offence, prosecution whereof is not required
by a published international convention. May
such interceptions and records of telephone calls be
used as evidence in the case? The author tries to answer
this question in the article.
Michal Králík: Legal Liability of Skiers for Injuries on Ski Slopes
The article dealing with legal liability of skiers for injuries
on ski slopes informs readers about basic rules
and principles followed upon assessment of such issues,
with emphasis on the rules issued by the International
Ski Federation (FIS). Its maps the very scarce
case law and doctrine developments in this sphere
in the Czech Republic and discusses solutions to
the stated issues in the Swiss, German, French and
English legislation developments, because literature
and court practice of these countries pay long-term
and considerable attention to the mentioned aspects.
The stated comparative view may inspire and benefit
the Czech specialized literature (almost missing so
far) and court practice in this sphere. Conclusions stated
in the article stress that also skiers are not
exempt from any criminal and civil liability for injuries
occurred in relation to skiing.
