PROGRESSIVISM, INDIVIDUALISM, AND THE PUBLIC<br />

INTELLECTUAL<br />

That is man is unto himself <strong>and</strong> in possession of both his property <strong>and</strong> his very person.<br />

He is independent of any o<strong>the</strong>r man. This is <strong>the</strong> true state of nature.<br />

He continues:<br />

"A state also of equality, wherein all <strong>the</strong> power <strong>and</strong> jurisdiction is reciprocal, no one<br />

having more than ano<strong>the</strong>r, <strong>the</strong>re being nothing more evident than that creatures of <strong>the</strong><br />

same species <strong>and</strong> rank, promiscuously born to all <strong>the</strong> same advantages of Nature, <strong>and</strong> <strong>the</strong><br />

use of <strong>the</strong> same faculties, should also be equal one amongst ano<strong>the</strong>r, without<br />

subordination or subjection, unless <strong>the</strong> lord <strong>and</strong> master of <strong>the</strong>m all should, by any<br />

manifest declaration of his will, set one above ano<strong>the</strong>r, <strong>and</strong> confer on him, by an evident<br />

<strong>and</strong> clear appointment, an undoubted right to dominion <strong>and</strong> sovereignty."<br />

Locke <strong>the</strong>n stipulates <strong>the</strong> creation of a society via <strong>the</strong> contract path saying:<br />

§ 78. Conjugal society is made by a voluntary compact between man <strong>and</strong> woman, <strong>and</strong><br />

though it consist chiefly in such a communion <strong>and</strong> right in one ano<strong>the</strong>r's bodies as is<br />

necessary to its chief end, procreation, yet it draws with it mutual support <strong>and</strong> assistance,<br />

<strong>and</strong> a communion of interests too, as necessary not only to unite <strong>the</strong>ir care <strong>and</strong> affection,<br />

but also necessary to <strong>the</strong>ir common offspring, who have a right to be nourished <strong>and</strong><br />

maintained by <strong>the</strong>m till <strong>the</strong>y are able to provide for <strong>the</strong>mselves.<br />

Locke shows that marriage is as much a contract between two people for procreation but<br />

he also infers it is a mutual interest pact. Two people enter into this contract (compact to<br />

Locke) <strong>and</strong> it is fundamentally <strong>the</strong> establishment of a mutual assistance pact, <strong>and</strong> in some<br />

ways this may open an interesting avenue to such contracts replacing a religious marriage<br />

act, which in <strong>and</strong> of itself was a sacrament separate from <strong>the</strong> state's protection.<br />

3.1.2 Compacts<br />

He starts with <strong>the</strong> compact between man <strong>and</strong> woman as <strong>the</strong> primal contract upon which<br />

all o<strong>the</strong>rs will be built. Locke <strong>the</strong>n extends this to society:<br />

"§ 87. Man being born, as has been proved, with a title to perfect freedom <strong>and</strong> an<br />

uncontrolled enjoyment of all <strong>the</strong> rights <strong>and</strong> privileges of <strong>the</strong> law of Nature, equally with<br />

any o<strong>the</strong>r man, or number of men in <strong>the</strong> world, hath by nature a power not only to<br />

preserve his property - that is, his life, liberty, <strong>and</strong> estate, against <strong>the</strong> injuries <strong>and</strong><br />

attempts of o<strong>the</strong>r men, but to judge of <strong>and</strong> punish <strong>the</strong> breaches of that law in o<strong>the</strong>rs, as he<br />

is persuaded <strong>the</strong> offence deserves, even with death itself, in crimes where <strong>the</strong> heinousness<br />

of <strong>the</strong> fact, in his opinion, requires it.<br />

But because no political society can be, nor subsist, without having in itself <strong>the</strong> power to<br />

preserve <strong>the</strong> property, <strong>and</strong> in order <strong>the</strong>reunto punish <strong>the</strong> offences of all those of that<br />

society, <strong>the</strong>re, <strong>and</strong> <strong>the</strong>re only, is political society where every one of <strong>the</strong> members hath<br />

quitted this natural power, resigned it up into <strong>the</strong> h<strong>and</strong>s of <strong>the</strong> community in all cases<br />

that exclude him not from appealing for protection to <strong>the</strong> law established by it.<br />
