Policy Implications<br />

There are no relevant policy implications pertaining to this matter.<br />

Legislative Implications<br />

The appointment <strong>of</strong> the Project Architect is within Councils power pursuant to the<br />

provisions <strong>of</strong> the Local Government [Functions and General] Regulations clause 11 (2) (e),<br />

which exempts tenders from being called if obtaining services from or through the State or<br />

Federal Government.<br />

Financial Implications<br />

Funding for the appointment has been allocated in the 2009/10 budget.<br />

Conclusion<br />

The appointment <strong>of</strong> the Project Architect will enable the design process to commence in<br />

order to facilitate community and stakeholder consultation on concept proposals to be<br />

carried out in December.<br />

Council will meet at a Special Meeting on 21 December 2009 to consider the costed<br />

concept plans and to make decision relating to the progress <strong>of</strong> the projects.<br />

RECOMMENDATION<br />

THAT COUNCIL:<br />

1. ACCEPTS the submission <strong>of</strong> CODA Design Studio Pty Ltd in the sum <strong>of</strong> Three<br />

hundred and seventy eight thousand four hundred and eight dollars<br />

($378,408.00) exclusive <strong>of</strong> GST for the design documentation and contract<br />

administration <strong>of</strong> the Baynton West Family Centre as detailed in the approved<br />

Project Design Brief ID# N1394, the Architectural Consultancy Brief ID# N1392<br />

and the submission from CODA Design Studio Pty Ltd dated 9 October 2009 ID#<br />

I183719.<br />

2. ACCEPTS the submission <strong>of</strong> CODA Design Studio Pty Ltd in the sum <strong>of</strong> One<br />

Hundred and sixty four thousand and forty two dollars ($164,042.00) exclusive <strong>of</strong><br />

GST for the design documentation and contract administration <strong>of</strong> the Bulgarra<br />

Community Centre detailed in the approved Project Design Brief ID# N1393, the<br />

Architectural Consultancy Brief ID# N1392 and the submission from CODA<br />

Design Studio dated 9 October 2009 ID# I183703.<br />

3. NOTES that budgetary allowance will have to be made for an estimated 38 site<br />

visits by the Design Team at an estimated cost $3,000 per visit which will be<br />

apportioned between the Baynton West Family Centre and the Bulgarra<br />

Community Centre on the basis that all site visits have the prior approval <strong>of</strong> the<br />

Project Manager.<br />

4. NOTES that CODA Design Studio Pty Ltd are required to enter into a Form <strong>of</strong><br />

Agreement in accordance with Australian Standard Contract AS 4122 – 2000<br />

General conditions for the engagement <strong>of</strong> consultants within twenty eight (28)<br />

days <strong>of</strong> appointment with respect to consultancies for the Baynton West Family<br />

Centre and the Bulgarra Community Centre as a single agreement.<br />
