As a result of public comment on the insurance requirements set forth in the contract, the Commission requested that the Sunnyvale Swim Team be prepared to provide Council with the financial impact to them if they were required to provide the same level of insurance coverage that the City is requiring of the Contractor. Staff recommends Alternative Number 1: Approve, in substantially the same form as attached, the proposed Agreement between California Sports Center and the City of Sunnyvale for the Operation of Public Swim Programs at Fremont High School Pool. Based on the City Attorney’s and the Risk Manager’s assessment of the City’s potential exposure, staff supports the level of insurance required in this contract, noting that it is up to the Contractor, not the City, to determine the appropriate insurance requirement for renters based on each specific renter’s potential exposure. Operation of the Fremont High School Pool requires a City subsidy under both options presented. However, the subsidy required is far less for the City to contract with California Sports Center than it would be to directly provide services. A number of factors impact the City’s subsidy amount including loss of time and revenue while the City establishes aquatic programming at a similar level to what is currently being offered and a variance in salaries between the two organizations. In addition, since the City does not have the staff expertise to run a full-scale, year-round, multi-program aquatics facility there would be a significant start-up time required before full services could be offered, which would negatively impact current and future users.
