submitted to CITY immediately upon making such change. If CITY is or becomes<br />

responsible for ongoing maintenance <strong>of</strong> the building interior, CONTRACTOR will<br />

make available to CITY the necessary number <strong>of</strong> keys for maintenance personnel.<br />

CITY, at its option, may make copies <strong>of</strong> the master keys available to the School<br />

District for maintenance and emergency purposes. CONTRACTOR shall comply<br />

with all building closure times necessary for CITY and District to complete planned<br />

improvements. Schedules for improvements shall be provided to CONTRACTOR<br />

well in advance <strong>of</strong> planned improvements.<br />

K. Communicate through the CITY any problems or concerns regarding<br />

issues covered by <strong>City</strong>-District Agreement.<br />

L. Promote and advertise all programs, for the health and welfare <strong>of</strong> the<br />

community, utilizing newspapers, flyers, email, social media, brochures, the<br />

CONTRACTOR’s website, etc. to ensure awareness <strong>of</strong> the program.<br />

M. Conduct a customer satisfaction survey <strong>of</strong> participants no less than<br />

annually and receive a minimum average <strong>of</strong> “very good” on services and<br />

maintenance that are under the control <strong>of</strong> the CONTRACTOR. On a scale <strong>of</strong> 1-5,<br />

“very good” is 4. CONTRACTOR shall submit results <strong>of</strong> the survey by November<br />

15.<br />

SECTION 10. PROHIBITED ACTIVITIES. CONTRACTOR shall not do any <strong>of</strong><br />

the following without having first obtained the written consent <strong>of</strong> CITY:<br />

A. Install or permit installation or use <strong>of</strong> any pinball machine, video game<br />

or similar equipment.<br />

B. Except on approved bulletin boards, attach, hang or otherwise affix any<br />

sign or advertising matter on the exterior or interior <strong>of</strong> the Pool or Pool Building.<br />

C. Allow any newspaper rack, vending machine or other sales device to be<br />

placed and maintained outside the Pool or Pool Building whether attached or free-<br />

standing, or anywhere in the Pool and Pool Building, except as authorized herein.<br />

D. Permit third parties to distribute or sell goods, wares or merchandise<br />

either within the interior or exterior <strong>of</strong> the Pool or Pool Building, or anywhere on<br />

the Fremont High School property other than Aquatics-related supplies at swim<br />

events.<br />
