PUBLIC CONTACT<br />
Public contact was made through posting <strong>of</strong> the May 8, 20<strong>13</strong>, Parks and<br />
Recreation Commission agenda on the <strong>City</strong>’s <strong>of</strong>ficial-notice bulletin board, on<br />
the <strong>City</strong>’s Web site, and the availability <strong>of</strong> the agenda and report in the Office <strong>of</strong><br />
the <strong>City</strong> Clerk. Public contact was made by posting the Council agenda on the<br />
<strong>City</strong>'s <strong>of</strong>ficial-notice bulletin board outside <strong>City</strong> Hall, at the <strong>Sunnyvale</strong> Senior<br />
Center, Community Center and Department <strong>of</strong> Public Safety; and by making<br />
the agenda and report available at the <strong>Sunnyvale</strong> Public Library, the Office <strong>of</strong><br />
the <strong>City</strong> Clerk and on the <strong>City</strong>'s Web site. Copies <strong>of</strong> this report were provided to<br />
David and Anne Peterson (<strong>California</strong> Sports Center), and Friends <strong>of</strong> Fremont<br />
Pool. Notice <strong>of</strong> Commission and Council meetings regarding this report was<br />
also distributed to the “Friends <strong>of</strong> Parks and Recreation” mailing list (a list <strong>of</strong><br />
organizations and individuals who have expressed an interest in parks and<br />
recreation issues).<br />
At the May 8, 20<strong>13</strong> Parks and Recreation Commission meeting, Dave Peterson,<br />
representing <strong>California</strong> Sports Center, indicated that although not mandated<br />
by the <strong>City</strong>, he would be requiring pool renters to hold the same level <strong>of</strong><br />
coverage that he, as Contractor, is required to hold ($5 million per occurrence<br />
and $10 million annual aggregate for bodily injury, personal injury and<br />
property damage). He speculated that, as a result, participant fees for<br />
<strong>Sunnyvale</strong> Swim Team (and other renters) might increase, and that these<br />
groups might not rent as much time as they would otherwise, thus negatively<br />
impacting participation and revenues. Margaret Copley, representing<br />
<strong>Sunnyvale</strong> Swim Team, indicated that the team had the ability through its<br />
insurance provider to obtain the same level <strong>of</strong> insurance that the <strong>City</strong> is<br />
requiring <strong>of</strong> the Contractor. However, she noted that she did not know the cost<br />
<strong>of</strong> doing so nor how that would impact the team.<br />
ALTERNATIVES<br />
1. Approve, in substantially the same form as attached, the proposed<br />
Agreement between <strong>California</strong> Sports Center and the <strong>City</strong> <strong>of</strong> <strong>Sunnyvale</strong> for<br />
the Operation <strong>of</strong> Public Swim Programs at Fremont High School Pool.<br />
2. Do not approve, in substantially the same form as attached, the proposed<br />
Agreement between <strong>California</strong> Sports Center and the <strong>City</strong> <strong>of</strong> <strong>Sunnyvale</strong> for<br />
the Operation <strong>of</strong> Public Swim Programs at Fremont High School Pool.<br />
3. Direct staff to directly operate the public swim programs at Fremont High<br />
School Pool and to prepare a Budget Modification to cover the costs.<br />
4. Provide other direction to staff as Council deems appropriate.<br />
RECOMMENDATION<br />
At its May 8, 20<strong>13</strong> the Parks and Recreation Commission met to review this<br />
