where appropriate. The fees are subject to approval by the CITY and are to include<br />

payment options such as daily punch card and/or monthly rates for all activities.<br />

E. Post and notify the public <strong>of</strong> fees and changes to fees.<br />

F. Collect and deposit all fees, charges and receipts for individual<br />

participation, for individual and group swim instruction, and for all swim<br />

reservations <strong>of</strong> the Pool and Pool Building.<br />

G Honor the rights <strong>of</strong> participants to waiver <strong>of</strong> fees, upon presentation by<br />

participants <strong>of</strong> an authorized CITY fee waiver form. CONTRACTOR shall keep<br />

accurate records <strong>of</strong> all fee waivers and shall provide CITY with such records not<br />

later than ten (10) days after the end <strong>of</strong> each calendar quarter for reimbursement<br />

and not later than June 25 th for the last quarter (fee waivers are not valid beyond<br />

June 15 <strong>of</strong> each fiscal year).<br />

H. Adopt and post a reservation policy subject to CITY approval that gives<br />

priority for reserved use to <strong>Sunnyvale</strong>-based businesses/groups over non-<br />

<strong>Sunnyvale</strong>-based businesses/groups.<br />

SECTION 9. ADDITIONAL DUTIES OF CONTRACTOR. CONTRACTOR shall,<br />

in addition to the foregoing duties:<br />

A. At CONTRACTOR’s discretion, maintain, sell and rent a stock <strong>of</strong><br />

merchandise, supplies and equipment sufficient to meet customer demand and<br />

suitable for use at the Pool and Pool Building including, for example, clothing, eye<br />

goggles, towels, books and other swim equipment and supplies, provided that the<br />

makes or lines <strong>of</strong> swim merchandise, supplies and equipment so handled shall be<br />

representative, in quality, price and type, <strong>of</strong> those makes and lines <strong>of</strong> swim<br />

merchandise generally available to the public in this area.<br />

B. At CONTRACTOR’s discretion, maintain and operate vending machines<br />

for the sales <strong>of</strong> food and beverages provided that within ten (10) days following<br />

receipt <strong>of</strong> written notice from CITY that a particular product or machine is not<br />

satisfactory to CITY for whatever reason, CONTRACTOR shall remove or have<br />

vendor remove that product or machine forthwith.<br />

C. Pay all charges for water, gas and electric service to the Pool Building,<br />

which, per the <strong>City</strong>-District Agreement, will be metered or measured separately<br />
