Hepatitis B vaccinations will be made available to employees whose work responsibilities<br />

place them at a potentially high risk of acquiring Hepatitis B. Identification of "potentially high<br />

risk" employees will be made in accordance with the guidelines from the Centers for Disease<br />

Control. Other employees may individually request the vaccine, in which case the respective<br />

facility Infection Control Coordinator will review the request and, within ten (10) working days of<br />

the request, notify the employee whether the vaccine will be provided. The criteria used for review<br />

by the Coordinator will be whether the specific job duties of the involved employees have placed<br />

them at a potentially high risk of acquiring Hepatitis B. The Coordinator's decision may be grieved<br />

but will not be overturned unless found to have been arbitrary or capricious.<br />

Grievances arising under this section may be submitted directly to the Joint Area<br />

Committee of the grievance procedure.<br />

Issues related to the prevention and treatment of communicable diseases are appropriate<br />

subjects for the agency-level health and safety committees established pursuant to Article 39,<br />

Section 2.<br />

Transportation<br />

The Employer agrees within 30 days of the effective date of this agreement to meet and<br />

discuss with the Union concerning the development or review of existing policies covering the<br />

transportation of residents/clients/patients.<br />

The purpose of this meeting is to provide the Union an opportunity to give input into the<br />

development of the policy. If a dispute arises during the course of these discussions which impacts<br />

on the health and safety of employees, then those issues may be submitted by the Union for review<br />

to a committee comprised of Council 13, the Agency and Office of Administration.<br />

If concurrence of the policy has not occurred at the committee level, then the Union may<br />

invoke the grievance procedure once the policy is implemented.<br />

The parties recognize that some employees may be assigned duties that will require<br />

possession of a Commercial Driver's License (CDL). The Employer will provide training, if<br />

necessary, to assist employees in obtaining a CDL when possession of such license is required to<br />

allow the employee to carry out their assigned duties.<br />

Career Development - Joint Committee<br />

A labor/management committee shall be established at the agency level to meet and discuss<br />

concerning career ladders for employees in the Human Services Unit.<br />

The purpose of this committee is to provide the Union an opportunity to give input into the<br />

development of policies dealing with career ladders. Due consideration shall be given to all<br />

meaningful suggestions made by the Union.<br />
