Seasonal Reassignments<br />

Section 1. Seniority application or any other arrangement relative to seasonal reassignments shall<br />

be negotiated at the local district office. If no resolution can be reached Section 2, below, will<br />

become effective.<br />

Section 2. Seasonal Reassignments to Winter Assignments<br />

When seasonal reassignments are made by the Department of Transportation affecting<br />

construction and materials personnel in the Technical Services <strong>Bargaining</strong> Unit and involving a<br />

move of such personnel from construction work to other types of work within the District, the less<br />

senior employees based on Master Agreement seniority shall be the first to be reassigned from the<br />

classification selected for reassignment; provided, however, that the employees retained on<br />

construction have the skill and ability to perform satisfactorily the construction work remaining to<br />

be done. At the time such seasonal reassignments are made the senior employees then affected, if<br />

qualified, shall be granted preferences from among the assignments then available. This provision<br />

shall not be construed to provide bumping rights for any employee. At each job site, permanent<br />

employees will not be reassigned before temporary, part-time employees and interns.<br />

During the month of October a labor-management committee meeting will be held at the<br />

district level for the purpose of apprising the Union of the projected job situation as it appears at<br />

that time.<br />

Section 3. Seasonal Reassignments from Winter Assignments<br />

The following steps will be used for determining the procedure for reassigning construction<br />

and materials personnel in the Technical Services <strong>Bargaining</strong> Unit in the Department of<br />

Transportation from their winter assignments.<br />

a. A meeting will be held in each Engineering District between appropriate local<br />

management officials and local Union officials.<br />

b. The purpose of the meeting is to agree to a procedure at the local level concerning<br />

the reassignment of employees from their individual winter assignments to the jobs<br />

such persons shall perform during the next construction period.<br />

c. The first such meeting at the local level shall be held within 40 calendar days from<br />

September 30.<br />

d. Agreement between the parties at the local level concerning the reassignment shall<br />

be realized within 40 calendar days from date of first meeting.<br />

e. In the event agreement cannot be reached at the local level mentioned in d. above,<br />

the matter shall be referred to Central Headquarters.<br />
