ERT members on approved leave will not be subject to availability criteria<br />

when on leave or for any holidays or regular days off that are contiguous to<br />

the approved leave.<br />

Additionally, an employee may be removed from the ERT for inability or<br />

unwillingness to perform or if he/she received two consecutive yearly performance<br />

evaluations below "meets objectives/factors" or receives discipline in the form of a<br />

one-day suspension or stronger. Removal for these reasons or non-availability is<br />

subject to the grievance procedure beginning at the first-step of the Accelerated<br />

Grievance Procedure.<br />

Removal from the ERT will be delayed, if the discipline is grieved in a timely<br />

manner, until the grievance is resolved. The Accelerated Grievance Procedure<br />

Panel and/or an Arbitrator can only consider if the discipline was appropriate, not<br />

that the employee will be removed from the ERT if the discipline is sustained.<br />

9. ERT members are guaranteed two hours of work on a portal-to-portal basis in call time<br />

situations.<br />

10. Payments by the Department for ERT membership will be $1277.50 bi-annually.<br />

a. Payments will be made bi-annually for the previous six months.<br />

b. An employee must be an ERT member for six months to be entitled to the first<br />

payment.<br />

c. After the first six months, if an employee leaves the ERT for any reason, he/she will<br />

receive a prorata payment.<br />

Department of Conservation and Natural Resources employees engaged in non-scheduled<br />

aerial flights who wish to take an approved AOPA Air Safety Foundation Pinch Hitters Course, to<br />
