to a position in a first level supervisory unit will have overtime equalized with other appropriate<br />

employees in the temporarily assigned classification in the first level supervisory unit during the<br />

temporary assignment. In this situation, the employee will be credited with the maximum amount<br />

of credited overtime held by an employee in the same classification in the equalization unit at the<br />

time the employee begins the temporary assignment and/or at the time the employee ends the<br />

temporary assignment.<br />

Section 6. Employees who are required to remain on duty during meal periods shall be<br />

compensated for these periods at the appropriate rate of pay. Employees who are not permitted to<br />

take rest periods during their regular shifts shall have that time counted as time worked in addition<br />

to that which is provided for in Section 2.<br />

Section 7. Payment for overtime is to be made the pay day of the first pay period following the<br />

pay period in which the overtime is worked. For the purpose of this Section, and in the<br />

determination of this time, pay periods will be considered as after-the-fact.<br />

Section 8. There shall be no duplication or pyramiding of any premium pay provided for<br />

under the provisions of this Agreement for the same hours worked. Time worked on holidays<br />

during an employee's regular shift shall not be excluded from hours worked for the purpose of<br />

determining eligibility for overtime pay under Section 1 of this Article.<br />

Section 9. When permanent full-time employees who normally perform a certain type of work<br />

within a seniority unit are on furlough, the Employer will not schedule other employees within the<br />

seniority unit to perform the same type of work on an overtime basis where such furloughed<br />

employees have the skill and experience to perform such work if the overtime involves full shifts<br />

and is expected to extend on a regular basis, for a period of four or more weeks.<br />

Section 10. Effective as soon as practically and legally possible, the Commonwealth will adopt<br />

a tax-qualified Leave Payout Plan. All employees who attain age 55 before or during the calendar<br />

year they separate from service after adoption of the Leave Payout Plan shall have the leave<br />

payouts otherwise payable for accumulated and unused Annual Leave, Personal Leave,<br />

Compensatory Leave, Holiday Leave and Sick Leave, up to the maximum allowable by law,<br />

deposited in an account in the employee’s name, provided however that if the total amount of leave<br />

payout is $5000 or less, this amount shall be paid to the employee in cash. Amounts in excess of<br />

the maximum allowable amount will be paid to the employee in cash.<br />

ARTICLE 21<br />

SHIFT DIFFERENTIAL<br />

Section 1. An employee whose work shift consisting of 7 1/2 or 8 work hours on a scheduled<br />

work day begins before 6:00 a.m. or at or after 12:00 noon will be paid a shift differential of $1.00<br />

per hour for all such hours worked on that shift.<br />

Section 2. Employees who work overtime on their work shift as described in Section 1, or<br />

who work not less than a full 7 l/2 or 8 hour shift which begins before 6:00 a.m. or at or after 12:00<br />
