c. Written local agreements concerning equalization units presently in existence shall<br />

continue subject to the expiration provisions in each local agreement. All such<br />

agreements and revisions thereto require the approval of the appropriate local<br />

<strong>Unions</strong> and District Council, Superintendents or designee and DPW Division of<br />

Labor Relations.<br />

Section 4. Equalization Units<br />

If agreement is not reached on an equalization unit and if neither party requests arbitration,<br />

the following equalization unit(s) shall apply:<br />

Section 5.<br />

a. All employees in the same classification who report to or are supervised by the<br />

same first-level of management, or designee, by shift and by organizational area.<br />

Organizational areas will be designated at the sole discretion of Management and<br />

shall be identified at the beginning of the equalization period.<br />

b. For those overtime assignments which require even minimal training periods,<br />

overtime will be equalized only among those employees in the classification who<br />

are capable of performing the assignment without training.<br />

c. Overtime involved in specialized functions will be limited to the employee(s)<br />

assigned to that particular function.<br />

Nothing in this Agreement shall require the Employer to accept as a volunteer or to assign<br />

mandatory overtime to an employee where the employee would be entitled to double time for such<br />

overtime work.<br />

Section 6.<br />

The requirements of Sections 1, 2 and 4 above shall be superseded by any procedure<br />

mutually agreed upon in writing by the Employer and the Union at an agency, institutional or local<br />

agency level. Such local agreements must be approved by the Local Union, the appropriate<br />

District Council, superintendent or designee and DPW Division of Labor Relations.<br />

For purposes of Sections 1 through 6 above, seniority shall be Master Agreement seniority.<br />

Sections 1 through 7 above supersede Article 20, Section 5 of the Master Agreement.<br />
