E. If the affected employee is unable to bump into any position as provided in (A),<br />

(B), (C), and (D) above, the employee shall be furloughed.<br />

F. Where the need for a furlough can be reasonably anticipated, the Department will<br />

notify the Union one month in advance of any impending furlough.<br />

Promotion of Entry Level Employees<br />

Employees classified as Auditor 1, Corporation Tax Officer 1, Public Assistance<br />

Investigator 1, Liquor Store Examiner 1, or Information Systems Auditor 1 will be given<br />

consideration for promotion to the 2 level of the respective classification after six months and prior<br />

to 24 months of employment, if the employee’s work performance and personnel record are<br />

satisfactory to the Department.<br />

Entry level employees (at the 1 level) in the Clerical Services and Building Services<br />

bargaining units will also be considered for promotion to the 2 level after six months and prior to<br />

24 months of employment if the employee’s work performance and personnel record are<br />

satisfactory to the Department, and the Department determines there is an operational need for the<br />

2 level work.<br />

The promotion will become final upon satisfactory completion of the six month<br />

probationary period.<br />

Should the Department determine that an employee’s work performance and personnel<br />

record are not satisfactory for purposes of promotion (or, where applicable, that there is not an<br />

operational need for the 2 level work), the employee may appeal the decision to the Department for<br />

reconsideration. The Department’s decision on reconsideration will be final and not subject to<br />

grievance procedures.<br />

Hours of Work<br />

The Department may change work schedules for 1) emergency reasons; or 2) to have<br />

auditors’ work schedules coincide with the auditees’ hours of operations. The Department agrees<br />

to meet and discuss with the Union prior to implementing any other work schedule changes or<br />

adopting schedules for new programs, as well as over the effects of any unilateral schedule change<br />

made pursuant to 1) or 2) above.<br />

Starting Pay Scale<br />

In recognition of the standard pay scale negotiated between the Commonwealth of<br />

Pennsylvania and the Union and in consideration of the Department’s need to recruit new<br />

employees with special qualifications, it is specifically agreed by the Department and Union that<br />

the Department shall have the right to hire new employees above the starting level for a specified<br />

pay group, based upon the employee’s education, experience, and other special qualifications, and<br />

as determined by the Department in its sole and absolute discretion.<br />
