Section 8. Loss of Benefits<br />

Employees who are separated from the service by a discharge under other than honorable<br />

conditions, bad conduct, or dishonorable discharge shall not be entitled to any of the benefits of<br />

Section 3 through Section 9 of the Article (relating to military leaves without pay) except such<br />

vested rights as they may have acquired thereto by virtue of payments made into their retirement<br />

accounts.<br />

Section 9. Physical Examination<br />

Employees shall be granted one day's leave with pay for the purpose of undergoing any<br />

physical examination that may be required in connection with entering the Armed Forces. An<br />

extension of such paid leave, not exceeding two additional days, may be approved by the agency if<br />

the employee certified in writing that more than one day is required to complete the examination.<br />

Section 10. For the purpose of this Article, the calendar year shall be defined as beginning with<br />

the employee's first full pay period commencing on or after January 1 and continuing through the<br />

end of the employee's pay period that includes December 31.<br />

ARTICLE 17<br />

LEAVES OF ABSENCE WITHOUT PAY<br />

Section 1. Employees may be granted leaves without pay at the sole discretion of the<br />

Employer for any reason for a period not to exceed two years.<br />

Section 2. Employees who are elected or appointed as Union officials or representatives shall<br />

be granted, at the written request of the employee, leaves without pay for the maximum term of<br />

office, not to exceed three years. Such leaves may be renewed or extended by written mutual<br />

consent of the Union and the Employer.<br />

Section 3. Union officials or elected delegates shall be granted, subject to management's<br />

responsibility to maintain efficient operations, up to six weeks leave without pay each year without<br />

loss of seniority credit where such time is necessary to enable them to attend official union<br />

conventions or conferences. Employees may use accrued annual or personal leave for this purpose<br />

in lieu of leave without pay.<br />

The following shall be recognized as official union conventions or conferences:<br />

1. AFSCME Council 13 Convention<br />

2. District Council Conventions<br />

3. AFSCME International Convention<br />

4. Pennsylvania AFL-CIO Convention<br />

5. AFSCME Women's Conference<br />

6. Coalition of Labor Union Women Conference<br />
