. During the initial 20 days (150/160 hours) of absence, paid annual and personal<br />

leave and/or unpaid leave shall be used and may include leave provided under Section 4 above.<br />

The additional sick family leave allowance must be used prospectively, and may not be<br />

retroactively charged for any of the initial 20 days (150/160 hours). A separate 20 day (150/160<br />

hour) requirement must be met for each different serious health condition and/or family member<br />

and for each calendar year, even if not all of the additional days were used during the previous<br />

calendar year.<br />

c. The initial 20 days (150/160 hours) of absence may be accumulated and the<br />

additional leave may be used on an intermittent basis.<br />

d. Proof of the family member’s serious health condition as defined by the Family and<br />

Medical Leave Act must be provided on the Commonwealth’s Serious Health Condition<br />

Certification form. Proof may be required for each absence during the 20 day (150/160 hour)<br />

period and subsequent additional sick family leave period.<br />

e. Family member for the purposes of this Section is defined as the following persons:<br />

husband, wife, child, step-child, foster child, or parent of the employee or any other person<br />

qualifying as a dependent under IRS eligibility criteria.<br />

Section 6. Employees may use up to five days of sick leave for the death of a spouse, parent,<br />

step-parent, child, or step-child and up to three days of such leave may be used for the death of a<br />

brother, sister, grandparent, step-grandparent, grandchild, step-grandchild, son- or daughter-in-law,<br />

brother- or sister-in-law, parent-in-law, grandparent-in-law, aunt, uncle, foster child, step-sister,<br />

step-brother, or any relative residing in the employee's household.<br />

Section 7. a. Employees who retire shall be paid for their accumulated unused sick leave<br />

in accordance with the schedule below if they retire under the conditions set forth in Subsection b.<br />

b. Eligibility for payment of benefits under Subsection a. is as follows:<br />

(1) Superannuation retirement with at least five years of credited service<br />

in the State and/or Public School Retirement Systems,<br />

(2) Disability retirement, which requires at least five years of credited<br />

service in the State and/or Public School Retirement Systems, or<br />

(3) Other retirement with at least 25 years of credited service in the<br />

State and/or Public School Retirement Systems.<br />
