Strategy and Planning Committee Agenda 16 February 2011 While the applicant is able to demonstrate a degree of planning need for the proposal, to overcome the planning scheme conflict, the site is not considered large enough or sufficiently vegetated to be able to adequately buffer the tower to reduce visual and residential amenity impacts on nearby properties. Furthermore, conditions of approval cannot adequately address these issues. The application is therefore recommended for refusal. OFFICER RECOMMENDATION That Council REFUSE application MCU20/2041 (Telstra Corporation Pty Ltd) for a Material Change of Use for Service & Utility – Type 3 Tower situated at 1 Illoura Place, Cooroibah described as Lot 2 SP213298 for the following reasons: 1. the proposal will significantly impact on the visual and residential amenity of nearby properties; 2. the site is insufficiently vegetated and sized to be able to adequately reduce the proposal’s impacts on nearby properties; 3. conditions of approval cannot be applied to adequately address the impacts on the nearby properties; and 4. the proposal conflicts with the Noosa Plan, in particular, provisions of the Cooroibah locality code, Infrastructure Uses Code and Landscaping Code. FINANCE AND RESOURCING Infrastructure Policy Branch indicates the proposal triggers contributions totalling $205 (based on the September 2010 Consumer Price Index), comprising trunk pathway, public open space and rural roadwork contributions. INTRODUCTION Background/Site History The subject site, and the adjoining allotment to the southeast, were created by development approval 07/0695 for a 1 into 2 lot subdivision. Site Description The subject site is located at the corner of Illoura Place and Jirrima Crescent and is approximately 2.1 ha in size. The allotment has frontages of approximately 130 metres to Illoura Place and 100 metres to Jirrima Crescent, with the land sloping gently to the southeast. The site has been partially cleared with some remaining mature and regrowth vegetation, including melaleucas, eucalypts, acacias and pines, scattered throughout the lot. The vegetation has a maximum height of between 10 to 15 metres. Existing development on the site consists of a detached house and shed near the Illoura Place frontage. Access is gained via a gravel driveway from that frontage. Attachment 1 shows a locality plan for the site. Surrounding Uses Surrounding development is largely characterised by detached houses on Rural Settlement zoned allotments. Some tracts of Open Space Conservation land are located to the east and west and an existing private airstrip is located on Rural zoned land 500 metres to the east. Page 140
Strategy and Planning Committee Agenda 16 February 2011 Proposal The application seeks to establish a 30 metre high telecommunications tower to provide wireless 3G network coverage for mobile phones and broadband internet in the Cooroibah area. The tower will carry both Telstra and Optus antennae, providing coverage for both their networks. The proposal involves the construction of a steel monopole with 16 panel and 1 parabolic antennae mounted on the top of the pole. Two small equipment shelters are proposed at the base of the tower, which is contained within a 90m 2 secured lease area. The lease enclosure provides a 1.4 metre buffer to the south eastern boundary and 16 metres to the south western boundary. The tower itself provides a minimum setback of 6.5 metres to the south eastern boundary. In the original application, the tower was proposed at 25 metres high. The applicant subsequently amended the application to increase the tower height to 30 metres to allow for the co-location of both Telstra and Optus antennae on the monopole. The proposed plans of development are included as Attachment 2. ASSESSMENT Noosa Iconic Panel The Noosa Iconic Panel has reviewed the proposal and advised that Council is to remain the Assessment Manager for this application. State Planning Policies/Management Plans The following State Planning Scheme Policies are applicable to this Application: - SPP2/02 Planning and Managing Development Involving Acid Sulfate Soils This State Planning Policy has been deemed by the Minister for Local Government and Planning as being appropriately reflected in Council’s planning scheme and, therefore, does not warrant a separate independent assessment. South East Queensland Regional Plan The development site is within the Rural Living Area of the South East Queensland Regional Plan. The proposed use is consistent with the strategies sought by the Plan for the Rural Living Area and does not trigger further assessment. Planning Scheme – The Noosa Plan Consistent Uses The site is located within the Cooroibah locality and is zoned Rural Settlement. The proposed Infrastructure Use Type 3 (Tower) is identified as an inconsistent use within the Locality Code. The proposed use is required to follow an impact assessable application process. An assessment against the relevant codes is provided below. Cooroibah Locality Code The use is identified as an inconsistent use within the zone and, therefore, conflicts with the Code. The applicable Overall Outcomes sought for the locality are: 5.8.2 a) New uses and works are located, designed and managed to— i be compatible with other uses and works; ii maintain the safety of people and works; iii avoid significant adverse impacts on the amenity enjoyed by users of other premises, including impacts on acoustic and visual qualities; and Page 141
