Precinct Class: Emerging Community Precinct Class and District Business Centre Precinct Class Existing Use of Land: Vacant PURPOSE The purpose of this report is to seek Council’s delegation for the determination of an application for Preliminary Approval (Section 3.1.6 of the Integrated Planning Act 1997) Overriding the Planning Scheme for a Material Change of Use for a mixed use master planned residential community on land situated south of the existing Pelican Waters community, west of the existing Diamond Head community and extending south to Bells Creek. The subject land is referred to as ‘Pelican Waters Southern Lake’. The delegation to the Chief Executive Officer is sought as the decision will be subject to the applicant signing an infrastructure agreement with the Council. EXECUTIVE SUMMARY At the Ordinary Meeting of Council on 17 November 2010, Council was briefed by officers on the proposed development. The focus of that meeting was to inform Council of the need for an Infrastructure Agreement with the applicant in order to progress the determination of the application. At that meeting, a number of key infrastructure items were discussed and council resolved: That Council note the Chief Executive Officer will continue to negotiate an Infrastructure Agreement for the proposed Pelican Waters Southern Lake Material Change of Use Preliminary Approval (section 3.1.6 Integrated Planning Act 1997), as outlined at the confidential meeting. Through negotiations, the parties have agreed to all matters as generally outlined to Council on 17 November 2010. All the outcomes relevant to the Infrastructure Agreement have been summarised below. The application is generally consistent with the Caloundra City Plan’s intent for development of the subject land which started with a rezoning of the land 15 years ago. This Preliminary Approval represents the next logical stage in the development of a compact and sustainable activity centre to service the southern most coastal community of the Sunshine Coast. Strategy and Planning Committee Agenda 16 February 2011 OFFICER RECOMMENDATION That Council: (a) approve Development Application for Preliminary Approval (Section 3.1.6 of the Integrated Planning Act 1997) Overriding the Planning Scheme for a Material Change of Use for a mixed use master planned residential community at Bledisloe Boulevard and Harbourlights Way, Pelican Waters, described as Lots 812 and 813 SP212859 subject to: (i) the signing of the Infrastructure Agreement in accordance with the report; and (ii) Conditions as contained within Appendix A; (b) delegate authority to the Chief Executive Officer to determine all requests for 2009/510022 for Negotiated Decision, Change to Development Approval, Change or Cancel Conditions and Extension of Relevant Period; and (c) authorise the Chief Executive Officer to communicate to the relevant State (Environment and Natural Resource Management) and Federal (Environment) Ministers, that this application be referred to the Commonwealth for an assessment under the Environmental Protection and Biodiversity Act. FINANCE AND RESOURCING Should approval be granted, most standard development contributions in accordance with Council’s Planning Scheme Policies will be applicable to this application and subsequent development applications. The exceptions to these requirements, where off-sets will apply because of the provision of infrastructure with the development, will be established within the Infrastructure Agreement. Infrastructure Agreement Because a number of the desired outcomes require deviation from Council’s established Policy, it will be necessary to establish an Infrastructure Agreement with the applicant prior to the determination of the application. At the 17 November 2010 Ordinary Meeting, Council established a position in terms of the expected minimum infrastructure requirements that are to be agreed and contained within an Infrastructure Agreement, prior to the application being decided. The infrastructure items tabled at the Ordinary Council Meeting included: • Open Space and Playing Fields; • Community Facilities; • Waterways Maintenance and Operational Contribution; • Pedestrian and Cycle Network; and • Walkable Waterfront.
