Summary of Injection Control Rules<br />

Underground <strong>in</strong>jection procedures govern<strong>in</strong>g operations <strong>in</strong> Texas are prescrtbed by<br />

Statewide Rules 9. 46. and 74. Chapter 27 of <strong>the</strong> Texas <strong>Water</strong> Code. and Title 3 of <strong>the</strong> Texas<br />

Natural Resources Code. Highlights 'of <strong>the</strong>se directives are outl<strong>in</strong>ed below; however. it is<br />

essential that <strong>in</strong>dividuals or entities engaged <strong>in</strong> underground <strong>in</strong>jection operations be<br />

thoroughly familiar and comply with <strong>the</strong>se requirements on a timely basis. A copy of all<br />

Statewide Rules may be procured by contact<strong>in</strong>g <strong>the</strong> Secreta.ry. Railroad COmmission of<br />

The StatewIde Rules applicable to disposal wells. Injection wells. and hydrocarbon<br />

storage wells are Rules 9. 46. and 74. respectively. These rules are summarized below:<br />

however. <strong>the</strong> complete Rules 9. 46. and 74 and applicable fonns with <strong>in</strong>structions may be<br />

found <strong>in</strong> Appendixes B and C. respectively. <strong>in</strong> this report.<br />

The Commission has adopted Statewide Rule 81 concern<strong>in</strong>g br<strong>in</strong>e m<strong>in</strong><strong>in</strong>g <strong>in</strong>jection wells.<br />

Rule 81 will become effective upon approval by EPA of <strong>the</strong> Commission's regulatory program<br />

<strong>for</strong> <strong>the</strong>se wells.<br />

Rule 9-Disposal Wells<br />

Infonnatlon regard<strong>in</strong>g <strong>the</strong> disposal of salt water. or o<strong>the</strong>r oU and gas waste. by <strong>in</strong>jection<br />

<strong>in</strong>to a porous fonnation not productive of 011: gas. or geo<strong>the</strong>nnal resources is outl<strong>in</strong>ed <strong>in</strong><br />

Statewide Rule 9. O<strong>the</strong>r matters conta<strong>in</strong>ed In <strong>the</strong> Rule consist of fiUng of application (Form<br />

W-14): notice and opportuni ty <strong>for</strong> hear<strong>in</strong>gs: protested applications: geological requiremen ts:<br />

and special eqUipment reqUirements.<br />

The Rule also outl<strong>in</strong>es Instructions regard<strong>in</strong>g records ma<strong>in</strong>tenance. and monitor<strong>in</strong>g and<br />

report<strong>in</strong>g, test<strong>in</strong>g and plugg<strong>in</strong>g disposal wells. Fur<strong>the</strong>r. it outl<strong>in</strong>es Instructions regard<strong>in</strong>g<br />

penalties to be Imposed <strong>for</strong> noncompliance wi th <strong>the</strong> Rule. Penni t revocation may result as a<br />

consequence of noncompliance.<br />

Rule 46- Fluid Injection <strong>in</strong>to Productive Reservoirs<br />

Statewide Rule 46 governs applications <strong>for</strong> <strong>the</strong> penniwng offluid <strong>in</strong>jection <strong>in</strong>to reservoirs<br />

productive of 011. gas or geo<strong>the</strong>rmal resources. Application <strong>for</strong> a pennit is on Railroad<br />

Commission Forms H-l and H-IA. The Rule also conta<strong>in</strong>s matters regard<strong>in</strong>g: <strong>the</strong><br />

application review: notice and opportunity <strong>for</strong> hear<strong>in</strong>g: protested applications: and<br />

modification. suspension or tenn<strong>in</strong>ation of pennlts <strong>for</strong> one or more of several causes.<br />

Included In Statewide Rule 46 are reqUirements regard<strong>in</strong>g: cas<strong>in</strong>g and cement<strong>in</strong>g (In<br />

accordance with Statewide Rule 13): special eqUipment (tub<strong>in</strong>g and packer. pressure<br />

observation valves): records ma<strong>in</strong> tenance: moni torlng and report<strong>in</strong>g: test<strong>in</strong>g: plugg<strong>in</strong>g: and<br />

penalties <strong>for</strong> violations of <strong>the</strong> Rule.<br />

Rule 74-Underground Hydrocarbon Storage<br />

This Rule prescribes <strong>the</strong> methodology applicable to <strong>the</strong> pennlttlng of an underground ..<br />

hydrocarbon storage facility. It outl<strong>in</strong>es <strong>the</strong> procedures <strong>for</strong>: fil<strong>in</strong>g of applications (Form<br />

H-4): technical requirements pert<strong>in</strong>ent to <strong>the</strong> storage fac!l1ty: notice of and opportunity <strong>for</strong><br />

hear<strong>in</strong>g: transfer of pennlts: and subsequent Commission action.<br />
