The Chair declared the Conference Committee Report was<br />
adopted. Senator Barham moved to reconsider the vote by which the<br />
report was adopted and laid the motion on the table.<br />
CONFERENCE COMMITTEE REPORT<br />
Senate Bill No. 616 by Senator Chaisson<br />
June 20, 2004<br />
To the Honorable President and Members of the Senate and to<br />
the Honorable Speaker and Members of the House of<br />
Representatives:<br />
We, the conferees appointed to confer over the disagreement<br />
between the two houses concerning Senate Bill No. 616 by Senator<br />
Chaisson recommend the following concerning the Reengrossed bill:<br />
1. That House Committee Amendments Nos. 1 through 3<br />
proposed by the House Committee on the Administration of<br />
Criminal Justice and adopted by the House of Representatives<br />
on June 1, 2004, be adopted.<br />
2. That House Floor Amendments Nos. 1 through 4 proposed by<br />
Representative Jack Smith and adopted by the House of<br />
Representatives on June 14, 2004, be rejected.<br />
3. That House Floor Amendments Nos. 1 through 4 proposed by<br />
Representative Burrell and adopted by the House of<br />
Representatives on June 14, 2004, be rejected.<br />
4. That the following amendments to the engrossed bill be adopted:<br />
AMENDMENT NO. 1<br />
On page 1, line 2, after "R.S. 27:306(A)(4)(c)(vi)" insert "and (5)(b)<br />
and (E)(2)(c)"<br />
AMENDMENT NO. 2<br />
On page 1, at the beginning of line 3, delete "R.S. 27:306(A)(7)(b)"<br />
and insert "R.S. 26:71.1(4)(d) and R.S. 27:306(A)(7)(b) and (8) and<br />
311.3(C) and to repeal R.S. 27:306(A)(5)(d)"<br />
AMENDMENT NO. 3<br />
50th DAY'S PROCEEDINGS<br />
On page 1, line 6, after "exceptions;" insert "to authorize the leasing<br />
or subleasing of fuel facilities at qualified truck stop facilities; to<br />
provide for license qualifications when a video draw poker device<br />
license is sold or transferred; to provide for the one hundred eighty<br />
day time limit allowing the operation of video draw poker devices<br />
under an old license pending approval of a license to operate in the<br />
name of a new establishment owner; to provide an exception for<br />
suitability criteria for certified technician level two employees; to<br />
provide relative to the operation of video draw poker devices at<br />
certain golf courses; to provide with respect to the licensing<br />
requirements for the operation of video draw poker devices at certain<br />
golf courses; to provide relative to the sale of alcoholic beverages at<br />
certain golf courses; to provide for the issuance of a conditional<br />
alcoholic beverage permit to certain golf courses; to provide for the<br />
continued operation of video draw poker devices at certain golf<br />
courses;"<br />
AMENDMENT NO. 4<br />
On page 1, line 8, after "R.S. 27:306(A)(4)(c)(vi)" delete "is" and<br />
insert "and (5)(b) and (E)(2)(c) are" and on line 9 after "R.S.<br />
27:306(A)(7)(b)" delete "is" and insert in lieu thereof "and (8) and<br />
311.3(C) are"<br />
AMENDMENT NO. 5<br />
On page 2, between lines 6 and 7 insert the following:<br />
"(5) * * *<br />
(b) An owner or lessor of a qualified truck stop facility may<br />
lease or sublease any restaurant, convenience store, fuel facility, or<br />
any other business operation located on the premises of the qualified<br />
truck stop facility to another person, provided that such person<br />
executes a written lease which contains a requirement that the lessee<br />
or sublessee comply with the laws and regulations which govern the<br />
operation of video draw poker devices. If such lease or sublease is<br />
granted, the owner or lessor of such qualified truck stop facility shall<br />
maintain ultimate supervision and control of his entire truck stop<br />
premise. No such lessee or sublessee shall be required to meet<br />
suitability requirements unless he receives, as a result of the lease,<br />
any video draw poker device operation revenue or unless he exercises<br />
some management or control over video draw poker devices. Any<br />
violation of the laws and regulations which govern the operation of<br />
video draw poker devices by such lessee or sublessee shall be<br />
considered a violation by the licensee. No financial lending institution<br />
or pawnshop shall be located on the premises of a qualified truck<br />
stop facility. Nothing herein shall prohibit the placement of<br />
automatic teller machines on the premises of a qualified truck stop.<br />

AMENDMENT NO. 6<br />
On page 2, delete line 23 and insert the following:<br />
"R.S. 27:306(A)(8) is all proposed new law.<br />
(8) Notwithstanding any other provision of law to the contrary,<br />
a licensed establishment located at a public or private golf course<br />
licensed to operate video draw poker devices pursuant to the<br />
provisions of this Chapter prior to January 1, 2004, issued a Class<br />
A-Restaurant-Conditional permit issued pursuant to the authority<br />
granted in R.S. 26:71.1(4)(d) shall be authorized to continue to<br />
operate video draw poker devices, provided that the licensee of such<br />
a licensed establishment maintains continuous suitability and meets<br />
all other licensing criteria required by the provisions of this Chapter.<br />
