10.07 Transfer <strong>of</strong> Seniority and Service<br />

For application <strong>of</strong> seniority for purpose <strong>of</strong> promotion, demotion, transfer, lay<strong>of</strong>f and recall and<br />

service (including meeting any waiting period or other entitlement requirements) for purposes<br />

<strong>of</strong> vacation entitlement, health and welfare benefit plans and wage progression:<br />

(i)<br />

(ii)<br />

an employee whose status is changed from full-­‐time to part-­‐time/casual shall receive full<br />

credit for his seniority and service;<br />

an employee whose status is changed from part-­‐time/casual to full-­‐time shall receive<br />

credit for his seniority and service on the basis <strong>of</strong> one (1) year for each 2080 hours<br />

worked (1820 hours worked for the paramedic clerk).<br />

ARTICLE 11 LAYOFF AND RECALL<br />

11.01 Notice <strong>of</strong> Lay<strong>of</strong>f<br />

(a)<br />

In the event <strong>of</strong> a lay<strong>of</strong>f, Employees shall be laid <strong>of</strong>f from their work location in the<br />

reverse order <strong>of</strong> their seniority within their job classification subject to the ability and<br />

qualifications <strong>of</strong> the remaining staff to perform the available work.<br />

In the event <strong>of</strong> a proposed lay<strong>of</strong>f at the Rainy River District Social Services<br />

Administration Board <strong>of</strong> a permanent or long-­‐term nature or the elimination <strong>of</strong> a<br />

position within the bargaining unit, the Employer shall<br />

(i)<br />

(ii)<br />

proposed lay<strong>of</strong>f or elimination <strong>of</strong> position; and.<br />

provide to the affected employee(s), if any, who will be laid <strong>of</strong>f with no less than<br />

five (5) <br />

Where a proposed lay<strong>of</strong>f results in the subsequent displacement <strong>of</strong> any<br />

member(s) <strong>of</strong> the bargaining unit, the original notice to the <strong>Union</strong> provided in (i)<br />

above shall be considered notice to the <strong>Union</strong> on subsequent lay<strong>of</strong>f.<br />

(c)<br />

The parties agree that the issue <strong>of</strong> lay<strong>of</strong>fs are properly matters for discussion by the<br />

Labour Management Committee in accordance with the following mandate:<br />

(i)<br />

(ii)<br />

Identify and propose possible alternatives to the proposed lay<strong>of</strong>f(s) or<br />

elimination <strong>of</strong> position(s);<br />

Identify vacant positions with the Rainy River District Social Services<br />

Administration Board or positions which are currently filled but which will<br />

become vacant within a twelve (12) month period and which are either:<br />

(1) within the bargaining unit; or<br />

(2) not covered by a <strong>collective</strong> <strong>agreement</strong>.<br />
