If the employee has not obtained reactivation and/or re-­‐certification in SAED and Symptom<br />

Relief skills within this one (1) week period, the employee will be suspended without pay for a<br />

maximum period <strong>of</strong> three (3) months during which time the employee must obtain reactivation<br />

and/or re-­‐certification in SAED and Symptom Relief skills. If the employee has not obtained this<br />

reactivation and/or re-­‐certification, the employee will be terminated. If the employee is<br />

successful in obtaining reactivation and/or re-­‐certification during the three (3) month period, he<br />

will return to active duty as a PCP.<br />

The parties may agree, in writing, to extend the unpaid suspension period if they agree that the<br />

circumstances warrant such an extension.<br />

ARTICLE 16 CONTRACTING OUT AND WORK OF THE BARGAINING UNIT<br />

16.01 No Contracting Out<br />

The Employer shall not contract out any work usually performed by members <strong>of</strong> the bargaining<br />

unit if, as a result <strong>of</strong> such contracting out, a lay<strong>of</strong>f <strong>of</strong> any employees other than casual part-­‐time<br />

employees results from such contracting out.<br />

16.02 Work Performed by Members<br />

Notwithstanding the foregoing, the Employer may contract out work usually performed by<br />

members <strong>of</strong> the bargaining unit without such contracting-­‐out constituting a breach <strong>of</strong> this<br />

provision if the Employer provides in its commercial arrangement contracting out <strong>of</strong> the work<br />

that the contractor to whom the work is being contracted, and any subsequent such contractor,<br />

agrees to employ the employees thus displaced from the Employer, and in doing so to stand,<br />

with respect to that work, in the place <strong>of</strong> the Rainy River District Social Services Administration<br />

Collective Agreement with the <strong>Union</strong>, and execute an<br />

<strong>agreement</strong> with the union to that effect.<br />

In order to ensure compliance with this provision, the Employer agrees that it will withdraw the<br />

work from any contractor who has failed to meet the aforesaid terms <strong>of</strong> the contracting-­‐out<br />

arrangement.<br />

16.03 Work <strong>of</strong> the Bargaining Unit<br />

Employees not covered by the terms <strong>of</strong> this Collective Agreement will not perform duties<br />

normally assigned to those employees who are covered by this Agreement, except for the<br />

purposes <strong>of</strong> instruction, experimentation, or in emergencies when regular employees are not<br />

readily available.<br />
