ESSENTIAL AMBULANCE SERVICES AGREEMENT<br />

BETWEEN:<br />

THE RAINY RIVER DISTRICT SOCIAL SERVICES<br />

ADMINISTRATION BOARD<br />

<br />

-­‐ AND -­‐<br />

CANADIAN UNION OF PUBLIC EMPLOYEES<br />

AND ITS LOCAL <strong>4807</strong><br />

<br />

WHEREAS the Employer and the <strong>Union</strong> are parties to a Collective Agreement expiring September 29,<br />

<br />

WHEREAS in accordance with Section 3 <strong>of</strong> the Ambulance Services Collective Bargaining Act <br />

the Employer and the <strong>Union</strong> agree to the following E<br />

A. STRIKES AND LOCKOUTS<br />

1. The Employer and the <strong>Union</strong> agree that there shall be no strikes or lockouts as defined in the<br />

Labour Relations Act, 1995, so long as the Collective Agreement between the parties continues<br />

to operate.<br />

2. In the event <strong>of</strong> a strike or lockout, it is understood and agreed that employees who are on strike<br />

or locked out shall not be entitled to pay, seniority or service accumulation during the period <strong>of</strong><br />

the strike or lockout, except as otherwise provided herein with respect to essential services.<br />

3. The cost <strong>of</strong> benefits for those employees who actively participate in the strike, or who are locked<br />

out, shall be borne by the <strong>Union</strong>. The Employer shall in such circumstances continue coverage<br />

and invoice the <strong>Union</strong> accordingly, and the <strong>Union</strong> shall remit payment within sixty (60) days <strong>of</strong><br />

the date <strong>of</strong> the invoice.<br />

4. In accordance with Section 15(2) <strong>of</strong> ASCBA, the terms and condition <strong>of</strong> the bargaining unit<br />

members who perform services under the ESA shall be in accordance with those terms and<br />

conditions specified in the Collective Agreement between the parties. Where the terms and<br />

conditions <strong>of</strong> the Collective Agreement or any practice are inconsistent with the ESA<br />

(particularly, but in no way limited to, hours <strong>of</strong> work and scheduling) the provisions <strong>of</strong> this ESA<br />

shall govern.<br />
