A copy of the current HOODIP plan text or, where applicable, the master policy of the current HOODIP equivalent shall be provided to the Union to the extent that this is within the possession of the Employer. 19.03 Employment Insurance Commission (EIC) The short-‐term sick leave plan shall be registered with the Employment Insurance Commission be retained by the Employer towards offsetting the cost of the benefit improvements contained in this agreement. 19.04 Sick Leave With Full Pay Sick leave with full pay will be granted to regular full-‐time employees on the following basis: (a) (b) When sick leave is claimed, proof of disabling sickness or accident will be furnished by a certificate from a duly qualified medical practitioner, unless waived by the Employer. When sick leave is claimed and upon the request of the Employer, proof of the disabling sickness or accident will be furnished by certificate from a duly qualified medical practitioner. 19.03 Medical Certificates The Employer shall pay the full cost of any medical certificate required of an employee. 19.04 Termination of Sick Leave Benefits Sick leave benefits will cease on termination of employment, on reaching normal retirement age or death. An employee absent by reason of sickness or accident may elect not to take sick leave with pay. 19.05 Injury Pay If an employee is injured on the job and his supervisor excuses him from further duty for the alance of that shift and there shall be no deduction from sick leave or other credits. ARTICLE 20 -‐ WSIB CLAIMS AND MODIFIED WORK 20.01 Payment Pending Determination of WSIB Claims An employee who is absent from work as a result of an illness or injury sustained at work and who has been awaiting approval of claim for WSIB benefits for a period longer than one complete pay period may apply to the Employer for payment equivalent to the lesser of the benefit the employee would have received from WSIB benefits if the claim was approved, or the benefit to which the employee would be entitled under the short term sick leave plan. Payment will be provided only if the employee provided evidence of disability satisfactory to the Employer and a written undertaking satisfactory to the Employer that any payments will be refunded to the Employer following final determination of the claim by Workplace Safety & Insurance Board. If the claim for WSIB benefits is not approved, the monies paid in advance will be applied towards the benefits to which the employee would be entitled under the short-‐term sick leave plan. Any payment under this provision will continue for a maximum of fifteen (15) weeks. 20.02 Modified Work In respect to long-‐term injuries and illness, the Employer and the Union agree that in most instances it is in the best interest of both the Employer and the employee that the employee be returned to gainful employment at the earliest possible time. When it has been medically determined that an employee is unable to return to the full duties of her position due to a disability, the Employer will notify and meet with the employee and a members of the local executive of CUPE to discuss the circumstances The Employer agrees to include CUPE representatives in the development of an individua ARTICLE 21 -‐ HOURS OF WORK 21.01 Daily and Weekly Hours of Work The following provisions are intended to define the normal hours of work and shall not be construed as a guarantee of hours of work per day or per week or of days of work per week. The normal hours of work for paramedics will be up to twelve (12) hour shifts (averaged over eight (8) weeks at forty (40) hours per week). The workweek shall be defined as Monday to Sunday.
