TOWN OF VERNON<br />

ZONING REGULATIONS<br />

5.8 For the purposes <strong>of</strong> this section, the following definition shall apply:<br />

5.8.1 Regulatory Floodway: The channel <strong>of</strong> a river or other watercourse and the<br />

adjacent land areas that must be reserved in order to discharge the base flood<br />

without cumulatively increasing the water surface elevation more than a<br />

designated height.<br />

5.8.2 Base Flood: The flood having a one (1) percent chance <strong>of</strong> being equaled or<br />

exceeded in any given year.<br />

5.8.3 Flood Insurance Rate Map (F.I.R.M.): An <strong>of</strong>ficial map <strong>of</strong> a community on which<br />

the F.E.M.A. Administrator has delineated both the special hazard areas and<br />

the risk premium zones applicable to the community.<br />

5.8.4 Flood or Flooding:<br />

5.8.4.1 A general and temporary condition <strong>of</strong> partial or complete inundation <strong>of</strong><br />

normally dry land areas from:<br />

5.8.4.1.1. The overflow <strong>of</strong> inland or tidal waters.<br />

5.8.4.1.2. The unusual and rapid accumulation or run-<strong>of</strong>f <strong>of</strong> surface<br />

waters from any source.<br />

5.8.4.1.3. Mudslides (i.e., mudflows), which are proximately caused<br />

or precipitated by accumulations <strong>of</strong> water on or under the<br />

ground.<br />

5.8.4.2 The collapse or subsidence <strong>of</strong> land along the shore <strong>of</strong> a lake or other<br />

body <strong>of</strong> water as a result <strong>of</strong> erosion or undermining caused by waves or<br />

currents <strong>of</strong> water exceeding anticipated cyclical levels or suddenly<br />

caused by an unusually high water level in a natural body <strong>of</strong> water<br />

accompanied by a severe storm, or by an unanticipated force <strong>of</strong> nature,<br />

such as flash flood or an abnormal tidal surge, or by similarly unusual<br />

or unforeseeable event which results in flooding.<br />

5.8.5 New construction: For insurance purposes, new construction will pertain to<br />

structures for which the start <strong>of</strong> construction or substantial improvement<br />

commenced on or after the effective date <strong>of</strong> the Flood Insurance Rate Map.<br />

5.8.5.1 For flood plain management purposes, new construction means<br />

structures for which the start <strong>of</strong> construction or substantial<br />

improvement commenced after the effective date <strong>of</strong> these<br />

regulations.<br />
