ZONING REGULATIONS<br />
20.4.2.20 Commercial development limited to retail shopping, business or<br />
pr<strong>of</strong>essional <strong>of</strong>fice, or warehousing limited to storage <strong>of</strong> nontoxic,<br />
non-hazardous materials. Ro<strong>of</strong> and other building run-<strong>of</strong>f shall<br />
be retained and recharged on site to the maximum extent<br />
practical. All sanitary wastewater generated at the facility shall<br />
be conveyed <strong>of</strong>f-site via public sanitary sewers, when available<br />
within one thousand five hundred feet (1,500’) <strong>of</strong> the proposed<br />
development. If sewers are not currently available, the applicant<br />
shall submit a Plan <strong>of</strong> the treatment and disposal <strong>of</strong> wastewater<br />
pursuant to Section 20.6 <strong>of</strong> these <strong>Regulations</strong>. The Plan<br />
presented shall be based on sound engineering practices and<br />
shall include a written certification by a registered Pr<strong>of</strong>essional<br />
Engineer in the State <strong>of</strong> Connecticut that the proposed septic<br />
system will not adversely affect the underlying aquifer or<br />
recharge area. Septic systems permitted under this Section<br />
shall be for the sole purpose <strong>of</strong> disposing sanitary wastewater,<br />
and shall be designed in accordance with the appropriate local,<br />
state, and federal codes pursuant to Section 20.5.2 <strong>of</strong> these<br />
<strong>Regulations</strong>. All other forms <strong>of</strong> wastewater generated shall be<br />
contained and disposed <strong>of</strong>f-site. The burden to demonstrate that<br />
the aquifer and recharge areas will not be adversely affected by<br />
the proposed development will be on the applicant. The<br />
applicant shall connect to the public sewer system at such time<br />
as it becomes available. The Commission may, at its discretion,<br />
elect to retain the services <strong>of</strong> a qualified pr<strong>of</strong>essional at the<br />
applicant’s expense, to review the Plans and render an opinion<br />
on the Commission’s behalf.<br />
20.4.2.21 Non intensive agricultural uses: Pasture light grazing, hay,<br />
gardening, nursery, conservation, forestry, and harvesting<br />
provided that fertilizers, herbicides, pesticides, and other<br />
Leachable materials are not stored outdoors or in any other<br />
manner which would permit leakage there<strong>of</strong>.<br />
20.4.2.22 Proper operation and maintenance <strong>of</strong> existing water bodies and<br />
dams, splashboards, and other water control, supply, and<br />
conservation devices.<br />
20.4.2.23 Existing conforming commercial and industrial buildings and<br />
uses may be maintained, repaired, expanded, or altered<br />
notwithstanding any change in ownership, but subject to the<br />
provisions <strong>of</strong> this district and the underlying zoning district.<br />
