ZONING REGULATIONS<br />

20.4.2.23.1 This section shall not apply to the expansion <strong>of</strong><br />

uses listed in Section 20.4.1 above and shall<br />

supersede Section 11 <strong>of</strong> these <strong>Regulations</strong>.<br />

20.4.2.23.2 The Special Permit shall be granted for the repair,<br />

expansion or alteration <strong>of</strong> existing conforming<br />

structures and uses if said structure is connected to<br />

public sanitary sewers.<br />

20.4.2.24 Any use which increases the lot coverage to sixty (60) percent or<br />

more.<br />

20.5 Density <strong>Regulations</strong> applying to the Aquifer Protection Zone:<br />

20.5.1 The Commission may increase the lot coverage if an applicant’s civil<br />

engineer registered in the State <strong>of</strong> Connecticut having the appropriate<br />

qualifications, shall declare in writing that the increased lot coverage will<br />

not adversely affect the underlying aquifer or recharge area. The plan<br />

presented shall be based on sound engineering practice and the burden to<br />

demonstrate that the aquifer or recharge areas will not be adversely<br />

affected will be on the applicant.<br />

20.5.2 In any Aquifer Protection Zone the density <strong>of</strong> design gallons per day <strong>of</strong> an<br />

on site sewage disposal according to State <strong>of</strong> Connecticut Public Health<br />

Code criteria shall not exceed one hundred (100) gallons per day per ten<br />

thousand (10,000) square feet <strong>of</strong> developable upland lot area (exclusive <strong>of</strong><br />

wetlands, floodplains, and impermeable surfaces). No additional<br />

development on an already developed site shall exceed this standard.<br />

20.6 Special Permit within the Aquifer Protection Zone:<br />

20.6.1 A Special Permit shall be granted if the PZC determine that Section 17.3 <strong>of</strong><br />

the <strong>Regulations</strong> and the intent <strong>of</strong> this section as well as its specific criteria<br />

are met. In making such determination, the PZC shall give consideration to<br />

the simplicity, reliability, and feasibility <strong>of</strong> the control measures proposed and<br />

the degree <strong>of</strong> threat to water quality. In addition the following shall apply:<br />

20.6.1.1 The use will not, during construction or thereafter, have a<br />

significant adverse impact on any aquifer or recharge area in the<br />

District and:<br />
