ZONING REGULATIONS<br />

20.6.3 Pesticide and Fertilizer Use: Any use which includes more than five (5)<br />

acres <strong>of</strong> land including, but not limited to, crop, lawn, garden or landscaping,<br />

requiring regular applications <strong>of</strong> chemical pesticides, or fertilizers shall be<br />

accompanied by a management plan. The management plan shall indicate<br />

types <strong>of</strong> materials, application schedule, and conformance with applicable<br />

best management practices.<br />

20.6.4 Parcels within or at the Boundary <strong>of</strong> the Zone: If new data on local<br />

hydrogeology and topography, acceptable to the PZC would lead to a<br />

different location <strong>of</strong> the boundary, the PZC shall, by map amendment, deem<br />

said parcel or boundary location to be the correct legal boundary for<br />

purposes <strong>of</strong> this section. The PZC may engage a registered pr<strong>of</strong>essional<br />

engineer or hydro geologist chosen by the applicant to conduct such a<br />

boundary analysis and shall charge the applicant for the cost there<strong>of</strong>. The<br />

procedures used in this section shall be the same as used for ESCP<br />

certification.<br />

20.7 Treatment <strong>of</strong> Pre-Existing Non Conforming Uses:<br />

20.7.1 Any construction or operation to be performed under a building permit or<br />

Special Permit issued prior to the effective date <strong>of</strong> this section shall conform<br />

with the requirements <strong>of</strong> this section unless the construction or operation is<br />

commenced within six (6) months after the issuance <strong>of</strong> the building permit or<br />

Special Permit and (for construction only) has been continued <strong>through</strong> to<br />

completion as continuously and expeditiously as is reasonable. Identical<br />

conditions shall apply on the occasion <strong>of</strong> any further amendment <strong>of</strong> this<br />

section.<br />

20.7.2 Any non-conforming use or structure, which is abandoned or not used for a<br />

period <strong>of</strong> one year or more, shall be subject to the provisions <strong>of</strong> this section.<br />

20.7.3 Deleted.<br />
